She's not a lawyer. Most people don't know that you can be charged for dui if you're under the legal limit. The ads on TV all say "Over the limit, under arrest." Nearly every time I tell people that you can be charged for dui even if you're under the legal limit, they're surprised. There's no need to make someone feel stupid just because they're not a lawyer.


I'm not an attorney. I've known about this since I first came to this fine country. Ignorance is no defense.

Why the hell would you violate probation on ARD? Beg or borrow the money you (not the insurance company) owe. Crazy stupid. I guess we all need text book examples.

Logically YOU were ordered to pay restitution. NOT your insurance company. YOUR criminal penalty is NOT the insurance company's responsibility.

You are a mom? Oh okay. Then realize this -- you drinking and driving could have killed another mom. You could have killed a child. YOU did damage someone's property.
For every instance there is always much more that can be said. For instance I've never broken a law in my life -
Bull. You drank, drove and cause property damage. You did break a law.

ever and heres a news flash the cop who interviewed me LIED, my blood alcohol level was at the limit,but I've learned through my experience a little tidbit that the general public may not know YOU DO NOT HAVE TO BE OVER THE LIMIT TO BE CHARGED OR CONVICTED, in fact the term legal limit is a LIE, a police officer can charge you if you have a fraction of alcohol in your system!!!
True. The term legal limit is not the proper term -- it is the layman's term. The legal term is PER SE LIMIT. Based strictly on the per se limit you are guilty. Below that limit you can still be convicted if you were driving and your driving was impaired. Which it was. Because YOU caused property damage. And how did the police officer lie? You didn't have to be over the per se limit. At the per se limit is still per se intoxication.

Your insurance company IS NOT court ordered to pay restitution. YOU ARE.

What I take exception to having said this is, had I known that they fully intended to violate me on this matter if it was'nt settled within the 6month probationary period I may have rethought my decision to enter the ard program and I may have just plead guilty to the dui and took the penalties, perhaps I am not coming across very well let me say I am not trying to get out of anything, I take full responsibility for my actions and I feel extremely remorseful for the damage I caused but where does it end / When a person is promised and agrees to certain conditions and lives up to them, and then on the very last day the rug is pulled out under you, your told you can go to jail, all the money youve paid means nothing community serviced?-to bad classes youve paid for and attended and fully participated in and took seriously- to bad start over from the beginning and be gratefull?
YOU did NOT take responsibility. YOU expect your insurance company to pay part of YOUR punishment. You miss the point. YOU are court ordered to pay restitution. NOT your insurance company. YOU. Be grateful you didn't kill someone. Be grateful that you didn't destroy a person's life. Be grateful that you didn't end up charged with more serious charges which could have ended your children having a mother at home. Should I continue?

Now pay the money YOU -- NOT your insurance company but YOU -- were ordered to pay. COMPLETE YOUR PUNISHMENT. That is not the insurance company's job to complete YOUR criminal punishment. That is YOUR responsibility. So quit making excuses and engaging in a pity party. Because quite frankly, you are attending all on your own.

That is because if you are over the limit it is automatically under arrest. You can still be arrested for being under the limit.

Since when do insurance companies not disclaim coverage for damages incurred while driving drunk? Do any of them actually not list that as an exclusion??

To all of those who have been negative!!!!!!!!!!!!

:) my case has been dropped and disposed of due to evidence presented to the court by me, Sooooo!!!!! To all those that keep referring to me in a negative way when I reply to others that post, I suppose that justice does prevail after all! My record will be expunged after a year and I can finally move on with my life having satisfied the court, which is warmly welcomed since I plan to move out of the state and start a new life with my family. To those who read my posts and understand what I was asking and trying to convey, Thanks.

if your case has been dropped, then you have no record to be expunged in one year. :rolleyes::rolleyes:

I was never charged in lieu of participating in the ARD program. I was referring to the charge of violating probation because of unpaid restitution.

My record will in fact be expunged!:p
