if a 21 year old female gets pregnant by a 16 year old what happens to the 21 year old? can the 16 year olds parents press charges? could the 16 year olds parents try to get custody of the baby? ....in the state of california

1. Yes, the parents can press charges.
2. Yes, the parents can try to get custody of the baby. They will, however, likely NOT be successful.

technically....the parents can file a report and the district attorney can press the charges. :p

I would just like to add, that IF the parents file a report, and the DA pickes up the charges (as they certainly should) AND if [mom molester] is convicted of a felony sexual abuse charge, the baby would MOST LIKELY be given to the dad to raise while [mom molester] served her sentence, then reunited with baby, but unlikely custody would change hands, unless all parties (molester and dad) agreed to give innocent baby back to mom.

The adult can get charged with a felony. The parents of the minor do not have to press charges. if anyone finds out about it, she can be prosecuted. Plus, the father of the child CAN sue for custody and since mom could well be in jail or prison, he just might gain custody.

Carl, I think the OP was asking if the minor father's parents can sue for custody of the child - not the father himself :)

Yep, I know. But, since the parents of the minor have no legal standing to sue, they would have to back their child's play. Unless they can argue that both the adult and their own child are unfit, the parents wouldn't stand much of a chance. And if they argue that the minor child they raised and are in charge of is unfit, that raises some other uncomfortable questions. Possible, yes - I have seen it happen - but generally only when the minor is also incapable of assisting with the baby due to jail or drugs.
