Privacy at school

What is the name of your state (only U.S. law)? CA

My daughter was recently arrested for taping a conversation without the other person's consent. The arrest occurred at her school in the privacy of the office - away from students and most teachers.

The next day, the Principal announced her arrest in a staff meeting, urging the teachers to report immediately if they heard her (and possibly the "victim") discussing it.

Aren't there privacy laws that protect my child? The taping did not occur at school and it was only brought to their attention by the "victim" insisting she get suspended.

She is a good kid who did a dumb thing and now she has had some school priviledges taken away with the teacher citing the reason being her arrest.

Yes there are privacy laws, and YOUR DAUGHTER violated them.

therefore she is subject to legal action and discipline from the school, all of which are public record. there was nothing wrong with the principal investigating the matter further by asking around.

I know she violated someone elses privacy and she will be punished accordingly by the court and she is being punished by her parents.

The arrest of a minor is public record. Really?

The school can choose to punish her for something that she didn't do there?

I'm curious as to what has happened with this incident. I would not think that a minor's record could be public because of privacy issues and age. How old is your daughter? I would also find it very suspicious that a school would suspend your daughter for something that happened off school property unless it involved danger to the victim??!??! I know California has different recording laws than the state I reside in.

First of all, arrests are public record. Even of minor's. And a school CAN suspend students for things that have happened off school property if they so wish.

The POLICE could not generally divulge this information to the general public, but it appears that the victim mentioned it to the school. As such, the school is within its rights to investigate if there were any similar incidents on campus. And, the school may well have had a right to the general circumstances surrounding the arrest depending on the details.

It depends on the details ... if it happened to or from school, or at a school activity, the school arguably has administrative jurisdiction. Note that the OP never mentioned their child was suspended, only that the victim wanted it to be so. There was a nebulous reference to some unspecified "privileges" being denied, but we have no idea what these might have been or whether the arrest was truly the reason for the denial.
