What is the name of your state (only U.S. law)? Wyoming

This evening my 17 year old daughter received a MIP by a DARE officer. She was at a school function that was not held at school. She was given a breathlizer which came out at .02. She was not driving. The DARE officer did not read her Miranda rights. We were notified after she was taken to the High School by the principal.

This is her first offense. We are wanting to know what we should expect in court as well as if the officer should have contacted us first or at least informed her of her rights.

She did NOT have to be informed of her rights. She was not interrogated. Doesn't matter if she was driving if the officer had probable cause which he most likely did. A .02 means she had alcohol.

Why are you more concerned about the police officer and not that your darling daughter was drinking in violation of the law?

She could face fines, community service, loss of her driver's license and discipline from the school (detention, suspension, removal from extra curricular activities) among other things.

Yup, Oggy is right.

Drinking at a school event carries its own set of penalties.... if princess was a member of an extra curricular, she isn't anymore.

You may want to have a long sit down with the princess. If she is drinking at 17, you may want to discuss what else she thinks she is old enough to do.

that wasn't rude. rude would have been assuming your drunken daughter was running around with the entire football team

you gave the facts. your daughter was drinking. that act of breaking the law comes with consequences. she's in trouble.
