16 year old daughter shoplifted

Hi, so yesterday my 16 year old daughter was caught shoplifting approximately $220 worth of merchandise from Kohls. They detained her and they made her write a letter of apology to the store. They told us a letter would soon be sent to us with an amount we would have pay. I have no objections to paying the fine for my daughter was guilty. My question is, once we pay the civil demand, what will happen? Will they call and notify her school (they asked for ID and she gave them her school one), will they pursue criminal/juvenile charges against her even though we will pay the amount without protest and no police were involved ?

if they want to pursue a legal conviction, it is their right to do so. some companies just want the restitution. some go to the extent the law allows. which is criminal charges AND restitution.

just curious, mom. why isn't the daughter paying for her crime as opposed to you paying it?

No worries, she will definitely be working hard to pay of the fine. Is it usually frequent that franchise stores pursue action beyond the civil demand to a juvenile?

Yes they frequently persue prosecution, especially for that amount. In addition your daughter's name will be entered into a national database. This one act of stupidity can haunt her for a very long time. It can even affect the possibility of her looking for a job in retail.

And one of the reasons they do pursue such things is because so often a juvenile-acquired theft habit does not cure itself.

The "caught" offense is rarely the the first offense.

I don't have time to look up a post - I think it was cyjeff who had an excellent answer to this kind of behavior. It went something like this:

All privileges are gone. Take away the cell phone. Remove the TV from her room. The computer is gone. She's grounded and that means grounded not just having a curfew. Take the door off her bedroom. She can get the door back once she reimburses you in full. She has to earn back the other privileges.

This is not her first time to shoplift - it's just her first time to get caught.
