What is the name of your state (only U.S. law) New York
I was waiting for a car at the curb to finish vacating the parking space so that I will be able to park. I got a ticket for Double Parking (f) (1). I am wondering if I can claim that I maybe violated No Standing but not Double Parking?

Parking. The standing of a vehicle, whether occupied or not, otherwise than
temporarily for the purpose of and while actually engaged in loading or unloading property or passengers.


This is the definition of "parking" from 4-01 of the NYC Traffic Rules. "Double parking" is simply parking while positioned on the street side of another vehicle that is parked at the curb.

The position of the gear shift lever doesn't matter.
You weren't in the process of immediate discharge of passengers or cargo.
Therefore you are parked.

You gotta learn to modulate your speed to arrive at the spot just as it is vacated by the other driver. NYC traffic games.

The vast majority of parking tickets issued in NYC are issued by Traffic Enforcement Agents, the vast majority of which are not authorized to issue summonses for moving violations. In the case of parking tickets issued in NYC for double parking to persons waiting to pull into a parking space that another vehicle is actually in the process of exiting, the vast majority of motorists are not interfering with traffic. Its just a case of TEAs trying to make daily quotas and get a better shift, and you are today's poor slob.
