Juvenile on Probation- Parent Moving

What is the name of your state (only U.S. law)? Arizona

Surprisingly, I didn't see this question posted already!

I have a child who is currently on probation for 1 year. It seems now that my family is being relocated out of state in the short future and I dont know what to expect from the court system. By the time of our relocation, my child will have completed 4-6 months of probation. The PO has said my child is well on target for early termination of probation, but indicated that early would mean maybe completing 9-10 months. This was a minor offense (not that I am making excuses) and the child is meeting all conditions and doing extremely well, so this is not the case of a continued problem. Will the minor child be released from probation? Will probation continue at a distance, or will the court insist the minor child remain in the state of Arizona until the probation is complete? It seems like it would be easy to assume what would happen...but I really do not know what to expect. Does anyone know the answer or can I be directed to case law or statutes that would explain all of this to me?? :eek:Thank you so much!

As is frequently said on these boards, the crystal ball is out being repaired, so we cannot say what WILL happen. A lot depends on the individual probation officer and the individual court.

A friend of mine, however, faced the same situation, and the end result was that her husband and other two sons made the move to SC while she and the son on probation remained in MA until his probation was up.

However, obviously that did not happen in AZ, so it may or may not be applicable. Sorry I can't be of more help.

You could request a transfer of Probation to the other state.

Although this is true, I do know that many times other states do not like to accept such a burden.
But this is for a juvenile. In most cases, juvenile probation transfers are approved with no problem as most juveniles don't have the choice of where to live. They live where their parents live. The juvenile and parents need to talk to the Probation Officer about applying for a transfer through the Interstate Compact.

Note: a transfer was turned down in my friend's case; thus their living in two different states for two years.
