Reimbursement of NSF fees

What is the name of your state (only U.S. law)? Louisiana

Father is court ordered to pay child support on the 1st Monday of every month. Last night I texted him and asked when he would deposit child support into my account. He told me Friday. Last night my checking account was hit with 3 NSF fees. Do I have any right to seek reimbursement of NSF fees since it was due yesterday? Thanks.

I seriously doubt it. Even if you figured the money would be there, you were foolish for drawing against it w/o knowing it was. Your bad, IMO.

If you wrote checks against a "future" deposit, no you have no standing.
 
The checks were dated for the 1st because child support was supposed to be in there, so the checks were posted on the 1st. I know it is my fault. It is hard being a single mom living from paycheck to paycheck. I was told the money would be in there and it wasn't. Per court order, child support to be deposited directly into my account on 1st of the month. You are right it is my bad, lesson learned.

It happens. I learned my lesson when I wrote checks based on getting paid on a Friday. Talk about panic when we weren't! Luckily,my boss was cool and arranged for me to get an advance from petty cash to cover what I'd written. But... never again.
 
It's good to have a good boss like that. Mine just whipped out his check book and is covering my fees. I won't ever do that again.

I work in default lending, and many people these days end up with NSF fees because THEIR clients/customers paid them with checks that ended up going NSF.

Is he self employed?
 
no, he claims that his family has been ill. i heard all about how he partied this past weekend though with the wife. Apparently they have been ill with the flu for last 2 weeks. He skipped his visitation and wants to make it up this weekend. I agreed last week, but when i found out that he and his wife were partying all weekend, i am having 2nd thoughts. Per our court order if we have to miss our weekends, they are forfeited, unless we can come to an agreement. I am so hot right now. He gets her whenever he feels like it, picks her up and drops her off at any time he feels like it, pays child support whenever he feels like it, and i have been trying so hard to work it out with him. I am so tired of court and attorneys, and we have been doing good for last year. We have court order that we have been deviating from and I don't know how to tell him in a nice way that we need to go by the court order. he will only get defensive, and this is not fair to me to have to jump when he is in the area to pick up our daughter, or when i have to wait for 45 minutes for him when visitation is over and I am in an empty parking lot alone waiting for the exchange. I can't ever make plans on Fridays because the time that he picks her up is always 2 to 3 hours longer than what the court order says. The time is when he feels like showing up to get her. I am so over this crap!! Sorry to write a book, just venting and crying at the same time. I am just overwhelmed.

This should be a lesson learned to not spend money that is not securly in your hands (account). Banks these days are less sympathetic and do not offer reversal of NSF fees as easily as they used to.

I remember many years ago a girl speaking to one of my associates. That associate would not reverse her fees so she wanted her manager. I saw $160 in fees (which was the max per day at that time). She had over 20 NSF days in the last 12 months and told me (as she did my associate) that it was our fault she could not buy diapers for her child.

Mind you the NSF fees were as a result of debits from Jamba Juice, Carls, Jr., Starbucks. Yep, it was the bank's fault she could not buy diapers:rolleyes:.
 
My money was strictly for uniforms next year (money was due to new school last Friday), lunch/breakfast at school, supplies for a project, and Before care at school. 3 of the 4 bounced last night. I don't blame the bank one bit and didn't even ask them for a courtesy refund. I learned my lesson, and he apologized and offered to compensate me for the hassle. That was pretty nice of him. So i won't spark off the nasty letter that i was in the middle of writing, but this is just his way of smoothing things over so he doesn't hear my opinions on the issues. I will choose my hill for now.
