Mom's Name On My Summons!

What is the name of your state (only U.S. law)? California

I was served a summons for a Complaint For Money... it says Limited Civil Case and references Rule 3.740 Collections.

Sadly, this will force me into bankruptcy. The debt is valid, but was incurred in 2007 and i am no longer in a position to pay it.

My question is, my Mom's name is also on the summons as a Plaintiff. She had nothing to do with this debt at all! A few years ago she had be add her name to her bank account in case anything ever happened to her. However, in 2009 we took my name off and instead filed a Power Of Attorney. So my guess is they are assuming my Mom has something to do with my finances. How can i get her name off? it is freaking her out!

Also, the summons was delivered to my Mail Stop, not hand delivered. I also never got anything in the mail which i read something had to be mailed within 10 days of serving if it was not hand delivered.

Any advice or help would be appreciated.

If mom is the plaintiff, she's the one suing you.
