I'm Guilty - but want opinions

What is the name of your state (only U.S. law)? MA

I broke a company policy by using a company corporate card for personal use. However, I have been paying it back (but there is a balance) - I did not hide the fact that I have been using and/or used the card. I have a meeting with HR tomorrow morning. What are the odds I'll get terminated? Or do you think they'll try to work with me?

Given the card is under my SSN and Name - doesn't the debt fall on me 100%. Could the company sue me and/or have me arrested for fraud? As I have been paying back the credit card, it's not as if I stole the money. We are talking less than $7k (if that matters).

Any thoughts, other than I'm a moron and a loser?? :confused:

Well, nobody here can guess the odds of you being terminated - the crystal ball has been missing for awhile now.

You should really see an attorney though, given that we're talking a wee bit more than $50 on the card.

How can you have a company CC under your name and SSN?

Either it is a corporate account or it is yours. If you do not get the bills, I would suggest it is not yours.

I'd say concentrate on updating your resume tonight. Violating the company's policy and trust in a manner you did is a career breaker.

I had one at the last place I worked....
Not the last place, but one of the ones before that, I did too. It was guaranteed by the company, but we got the bills and if we didn't pay up, the company had to.

We had someone fired just for that reason.

And if the company is guaranteeing the card, of course you "stole" the money. Or would you prefer "borrow without permission"? Same difference.

Under $7K? How much under $7K? Why would you think "under $7K" is somehow OK?

I'd be really surprised if they don't fire you.

What you did was take a huge unauthorized loan from your employer. Under 7K??? I presume you charged more than $6,500 to your employer. You may be paying your employer back but in the meantime, they have to pay the bill in full.

In all candor, I'd be surprised if you weren't terminated.

If the employee was an authorized user (permission) under the cardholder credit agreement, how do you get stolen or "borrowed without permission?"

And of course the poster can be fired for this.

The employee was authorized to use the card for business related purposes - NOT for personal ones. Personal use was NOT authorized - thus, stolen/borrowed without permission.
 
I was terminated

Thank you all for the advise.
I was terminated for "misconduct" - I made an error in judgement.
Provided I am in the process of paying back the debt, can I be proscuted for this and/or the company take further legal action?
Or as in end this is against my SSN, is this become just a credit issue?

The temination was legal.

You can still be prosecuted and sued even during your repayment process. The sooner you repay, the less likely it becomes that you will be prosecuted and/or sued.

In addition to the above, this is also a bad credit issue for you.

Yes, I agree the termination was legal.
So what will determine prosecution on this?

HR advised me that they will hold back X amount of pay and apply it towards the balance. Then the debt will be turned over to a collection agency.

I'm not concerned about my credit as that is already is the crapper.

However I am concerned about prosecution to the extend of the police rolling up and putting cuffs on. Is that a real concern in this case or as I am working with the company, paying back the debt, and the card in end was issued under my SSN - this falls on me (even if backed by the company).

I can handled being sued to - it's the whole jail thing that has me nervous.
 
Update

Just spoke to HR.

They with held X amount of my final check and gave that to the Credit Card.
This is now an issue between me and the Credit Card Company.
I will have X amount to pay the bill, if I don't pay it goes to collections.

From the companies perspective - we're done, no further legal action will take place. This is now a Credit Card issue between myself anc the Credit Card.

Few - that should translate to no cuffs... I realize I could be sued, however as I recall there is no such thing as credit card jail or else 75% of the US would probably be locked up! I'm sure I'm not the only one who has had bad financial issues...
