What is the name of your state (only U.S. law)? MN
I have full legal and physical custody of my son(16). Some time back, he went to his grandma's and has refused to come home...I know..I know...you are going to say who's the parent? I understand that. I have constantly said to him and his grandmother that he needed to come home. Since he has been there he has missed 15 days of school..14 being unexcused. He has failed about everything in school. His grandma has also taken the liberty to change his info at the Dr. and at his school to her address. I have changed these things back several times on both. Two days ago I called her as well as dozens times before that making it clear that he needs to come back home. I told her he needs to come back and if i had to I would get the police involved. She is telling me that he has the right to choose where he wants to be and the police would do nothing. Again he is 16. AUGH!! I don't know what to do. He is very defiant and listens to no one. I also want to be clear that is grandmother has no rights and has done no court action...what should I do? Help

go down to the police station and request an escort to go pick up your son.

how is granny changing the information at the school without legal guardianship?

where is the other parent?

ok..

Mom has no rights. She lost them in court. Mom refuses to see him..I just got papers sating she doesnt want to pay child support either. My guess is as good as yours as far as switching the address and such. I asked these same questions and I tend to get the run around from the Dr. and the school.

you might want to consider speaking to a family law attorney. this sounds like a really bad case of parental interference. on granny's part.

You need to very clearly tell the doctor and the school that if they ever again change your son's address to any address other than yours, you will report them to the relevant authorities (i.e., the state licensing bopard, the school board, the police). A "run around" simply will not suffice anymore.

I agree

I have spoke with the attorney that helped me with the custody case. She said that I have the right to take him back. The problem being..besides physically removing him..what can I do? When I state these things to the dr's ofiice, I hear "You are putting this Dr's office in a bad place"...I don't know..I do not want to sit back and take this. I fought so hard in court to have a better life for him. The grandma is my ex's mother. Which I think is weird. Or maybe I am reading between the lines? I just want to be sure if I make the call to the police..they will back me up and make him come with me. Immediatley them, I will pursue help for him. Which I have done several times in the past.

Take the court order with you showing that you have custody. You know the child will rebell like no tommrow so be prepaired I would have a counsling appt scheduled for the day you go and get him. It might be less dramma to get him from school?
