MSDN Fraud keys on ebay

So here is another ebay issue. So i purchased 2 of

New Window 7 Ultimate Full retail! Look!!! 64 or 32bit - eBay (item 200441507528 end time Feb-20-10 11:45:04 PST)

Too good to be true right? righhhhtttt. So i received these feb the 22. I install them shortly after (3-4 days before March 1st.), I activate the key on both just fine, so i didn't realize anything was wrong with my keys. Over 60 days later I get a nice little icon at the bottom right of one of my computer screens saying oh hey your copy of windows may not be genuine. So i call up Microsoft and ask what is the problem. They tell me that My key is an MSDN key. And i also confirm that my other key is an MSDN key as well.

(long story short, I am told (from Microsoft support) that it is illegal to sell MSDN keys. They are only used by people who have a subscription with Microsoft Developers network, and can only be used on machines for developmental research. To sell them is in violation of there agreement, and needless to say they make alot of money from the scam. and is HIGHLY ILLEGAL. Where as Retail keys (that are legal) are the ones that are suppose to be sold in the Box container. MSDN keys are never sold in boxes, in-fact you can only get them offline. what is even wonderful is it can take months or even years before you find out your key is an MSDN key and it can be black listed at any moment. You can not get your key back or a new one with out being a MSDN subscriber AND using it for Developmental purposes. Also there is no way unless you specifically call Microsoft about it. So obviously i didn't know until it was to late.

sooo back to the story. I contact the seller, he cusses me out for leaving a negative feed back (poor baby), because he was willing to give me ... another key... which im sure was another MSDN key and would get black listed.. again. Hes not responding to me for a refund. Ebay wont help me at all because its past the 45 days mark. I reported the fraud to piracy, i have Microsoft sending me Physical evidence that to sell these is illegal. I'm collecting all information i can. I still have the boxes.

I spent 370$ total through Paypal, I know there isn't probably much i can do. But at this point, im stressed, tired, I missed work to spend all day trying to find something to help me out, while on phone tag to everyone. And i just need any kind of hope. I want to take him to court... Hopefully i can get some good news

Well i was hoping the part about Fraud would fill in my reason for posting. I want my money back but he wont refund me, can i take him to court for fraud and if so How. He is in IL and i am in AL. I'm new at this so please try not to take too much online irritation out on me, I haven't a clue what i'm doing. I'm just looking for any help from friendly, understanding people.

You'd have to sue him in Illinois in small claims.

Did you fund your PayPal purchase with a credit card? If you did, you can file a chargeback with the CC company.

I did contact my Bank and they had me call a dispute center. They said because i authorized a sale and there is a no refund on the website that there isn't much they can do, but maybe i needed to talk to some one higher up? Also I have contacted Microsoft and they are emailing me the information i need to have as proof to show that it is illegal to sell the product as he did.

I don't see any negative feedback for that seller apart for MS office. Are you sure you negged him?

I believe you have 60 days to file a dispute with paypal.

If paypal is no help, do a chargeback. Simply state you didn't get what you paid for and the product sold is counterfeit/illegal.
