Girlfriend caught shoplifting in WalMart

State: NC- Charge, Misdemeanor larceny

Hello.

My girlfriend who is in a group home was recently caught shoplifting with some of her friends.

She has a Class A felony on her record, she got it when she was 15 yrs of age. She was also charged with runaway from her foster home a while back, because she attempted to *run away*.

She is in another part of the state right now and I am concerned that she might go to jail.

What is the likelihood of her going to jail based on this knowledge? Her court date is in July, and she will turn 18 then. Is it imperative that she get a lawyer for case?

Whats the worst that can happen?

I would love to know how she isn't in jail for the class A felony. The penalty for a class A felony in NC is death or life in prison.

I suggest she get a lawyer if she gets a traffic ticket let alone any actual crime.

Yes, she really does need one.

And, a bit of parental advice. Find a new girlfriend - this one is Trouble with a capital T. Next thing you know, the two of you will be expecting a little one, and your child will be stuck with her for life.

You know, that's a good question. Would she have gone to jail though even if she was 15 yrs old? 'Cause that's when it occurred. Also, she says that when she turns 18 she'll be able to get the the Class A expunged, or reduced, i dont remember.. You all know better than I do. But will they bring up the Class A on her record when she goes in July?

The CLASS A FELONY would be expunged or reduced when she turns 18? While stranger things have happened that would most likely take a pardon.

regardless of the situation, Please be optimistic, even though it may seem a difficult thing to do, because now shes "criminal" by societys standards.

All I want to know is whats the worse that could happen, even if she does get a lawyer. I don't just abandon people like that.

edit: i guess my optimism is contradictory to "whats the worst that could happen"

what i really mean is, instead of her going to jail, could she possibly get probation and/or community service instead?

from what I can find, there are only 2 class A felonies in the state of NC:


A G.S. 14-17 Murder in the 1st degree.

A G.S. 14-288.22(a) Unlawful use of a nuclear, biological, or chemical weapon of mass
destruction; punishment (injures another).
I don't think your GF is being honest with you or....?

and yes, at 15 she could be prosecuted as an adult.

Then you will stand by a lying thieving person? Quite frankly IF this was a CLASS A felony she is most likely going to jail. End of story. Because she would have broken the terms of her probation. And that is even saying that she would have received probation after three years and not still be in detention until 21. I believe your girlfriend needs a psychiatric evaluation based on what you have said she has said.
