What is the name of your state (only U.S. law)? Georgia

Ex was making in the area of $52000.00 (in 2006-07). He was fired from his job in January 2008 (for reasons unknown but definately fired). He ended up behind in CS and did not file for modification until Sept 2009. He got a job as a bus boy working part-time. I advised him of the mounting arrears and that he really needed to do something about it. He got a "better" job as a stock boy and is now making less than $16000.00 per year (based on CS review paperwork).

Does anyone know if showing past tax returns would be beneficial to object to the new CS amount? He has a college degree and I am trying to figure out if he is underemployed.

CS went from $825.00 per month to $284.00 per month with $100.00 toward the $9000.00 arrears.

The problem is, that in this economy, HUGE numbers of people are underemployed, taking any job they can get, just to have a job. I work in default loans, and I see this demonstrated daily. Many businesses are eliminating positions, outsourcing, or just going under if they don't find a way to run their business at lower cost. Those businesses still afloat are partially still afloat BECAUSE they cut overall costs, which can include salary costs. One reason some businesses are now gone is that they failed to reduce compensation to reflect market realities so they could compete.

Very true but he is in the restaraunt industry and even McDonald's isn't hiring him. I question that it is simply the economy.

Has the modification been finalized yet?

If it has, the only way you can object to the mount is if you can find a basis for an appeal. And, that is only if you file an appeal within the limited time frame after the order has been issued.

And he is far over qualified to work at Target as a stock boy. I get it. The review is not signed off on yet. I have until May 17. Just trying to be sure I am looking at this legally (what constitutes as proof of underemployment) rather than morally or emotionally.

Unfortunately it's going to be difficult to prove deliberate underemployment at this point.

It would have been easier to prove that if you or he had filed for a modification 2 years ago when he was first fired. At 2 years later, proving underemployment is going to be very hard due to the time that has elapsed and the economy.
