child accused of sexual misconduct

a neighbor accused my son, age 12, of touching her son, age 9, on the face with his genitals during a game. due to the nature of the game, leapfrog, it is impossible that the incident happened as she proposes. she filed a report with our apartment community office and the police. police officers came to my home and took my and my son's information and made a report. other children were present during the game and I am positive that it did not happen as described. we live in VA, what are my legal options?

Thank you for you reply. I am trying to find a Lawyer and currently waiting for one to call me back. I just thought that someone might know something what can be done because it was filled a false report about my son. Even that he was not charged with anything our information will be still in a system. I still don't get that there is someone that can even think about something like that...that is so sick.

How do you know it was a false report?

Were you present?

I was not there but there were other kids playing. You don't even know the whole story why you even bother to reply if you can't help. Kids were playing outside my building when "that" child joined the game. It was my sons turn to jump. He jump over him and the kid put his head down and poke him self on the head with the stick he was holding. My son and other kids took him home and that was it. That kid was like less then a minute in the game. Three days after that his mother came to conclusion that he touched him with his genitals on his face during the game. She came to my me and started calling us names and said that she will report it to the office and the police. I told her to leave my door before I call police. She left and next day cops showed up at my door. They did not charged him with anything by I want her to apologize to the office for making a false statement and to see if there is a way to take the report off from the records.
I understand what are you saying that kids are growing up and changing but if you do not know someone do not judge him. This is the first time in my life that anyone said anything about my child.
Me personally could not even think about something like that. I mean I was kid (many years ago) and remember rolling with kids on the ground after chasing someone and catching him. Should my mother call police every time she saw some kids touching me..... ??????????????

Quit whining. We OBVIOUSLY can't help you from behind the screen -- and especially if you hold back info and continue to be over-emotional.

The BEST thing you can do is hire an attorney, as you were told SEVERAL times. Both of your personas were told to hire an attorney, in fact.

It is easier to say then to do. It is maybe easy for you to say "hire attorney" I am a non working mother with two kids and if I had so much money to just go and hire a attorney I would not be here. I am trying whole day to get some free legal advice and I am still waiting for a attorney to call me back but in my states there are no free legal advice not in this case. I already spoke to the Legal Aid Society. I wish that it was so easy.

Yeah receptionist promised that the attorney will call me back after she gets back from court. Obviously will not happen.


Thank you for making me so bad in public, obviously you who ever you are do not have anything else to do then making bad comments.
My kids are very important to me and I will pay however I can get the money together. I did not ask for free attorney to represent me in court just to give me a free advice and tell me if there is anything that can be done.
