I need some help with an Ebay dispute

What is the name of your state (only U.S. law)? Texas and he's in Florida

Let me start from the beginning if that's fine. I sold a laptop to this guy on ebay for $620, he pays me, a couple days later he says I wasn't accurate in the description and opens up a claim which eventually leads to me having to refund his money in exchange for him sending the laptop back to me. I tell him to notify me when he is going to ship it but get no response for a couple of days. Now is when I realize that he is probably going to try and keep both the money and the laptop. He hasn't responded to any of my emails and messages. What would you all recommend I do? I have his address, phone number, email, and have saved all of the emails for the transaction and of our communication before he stopped responding.

How did he pay and how was the refund handled. Paypal will not refund on a return claim like this unless there is SIGNATURE CONFIRMATION at your end.

He paid through paypal and the refund was given through paypal also. I have extensive emails from ups stating that the package was delivered to his residence and messages stating that he had received it. What be some other alternatives in trying to get my money back?

Did you send him money? Press the refund button? Answer a dispute from PAYPAL?

Sounds like you did it wrong. You're probably screwed. If you're going to play ebay seller you gotta know the rules.

I refunded him his payment through paypal like it told me to and is still not sending the laptop. What kind of legal action can I take against him outside of ebay and paypal?

Roadtrip!


You will need to sue the guy in small claims court in his state.

Are you seriously considering traveling to Florida over this small amount of money? You can't recover your travel expenses...

I might since I would only be 2 states over in Mississippi. If not I would have 4 years to bring this to court according to this site Florida Statute of Limitations am I correct? Who knows I might make a trip down there for vacation sometime between then.
Well, good luck working this out...the more time that goes by, the less chance you have of doing anything successfully. Heck, what if the guy moves tomorrow?

It's your choice, but I bet that your non-reimbursable expenses add up to more than the ~$620 that you hope to gain.

How "who" told you to. A dispute doesn't require any proactive action on your part. Paypal will refund it when they get the signature confirmation report from the buyer.
