What is the name of your state (only U.S. law)? Kentucky
First of all, Thanks in advance for any help or insight you can provide. My brother just contacted me absolutely frantic and wanting to "pick my brain" I don't have the knowledge he needs right now, so I am turning to you for guidance.
My brother has joint legal custody of his 2 daughters and does pay child support, they do live with their mom. The mom and he do have a pretty good relationship, they do at least communicate. The oldest child will be 18 in June and the youngest just turned 17. Both of these girls have infant children, the oldest one's child is about 1 1/2 and the youngest has one that is about 9 months.
Neither of my nieces are with are with the babies fathers, however the fathers families in both situations do have regular visitation with the babies.
Social Services has been involved most especially due to my youngest nieces baby. Bottom line, the family wants custody of the baby. They have been very verbal about this and we strongly suspect that all of the "issues" being reported are due to them. One complaint that was investigated was because the baby was taken to Jewish Hospital instead of Nortons....baby had a cold and she was concerned about the breathing. They have visited the home multiple times and even though my niece is young (and dumb) mainly due to her Mom, the home is not an unfit situation. However, this particular worker is relentless. Most recently, they have required my x-sil and both of my nieces to submit to urine drug tests at a cost to them (my brother) or if they couldn't afford it be considered a "failure" and risk losing all of the children in the home (my x-sil also has a 3 yo)
Well, the results of that test came back negative. Now the worker says my x-sil and both of my nieces now have to submit to hair follicle testing. How can they get away with this? What can my brother do? Isnt this harrassment? They have complied with their every request, everything to date has be unfounded. This has become a fishing expedition, JMHO>
They are supposed to meet for the follicle testing in the morning but I told him to wait until I heard back from you guys. This is a small county where Im positive the back woods mentality and somebody knowing somebody is in full force. My x-sil has given her 3 yo to her Daddy to remove her from their clutches, my youngest niece has moved in with my brother in another state to distance her from the situation and my oldest niece is staying with other family.
