What is the name of your state (only U.S. law)? IL
Getting divorced after 3 1/2 years. No kids involved. We have a house bought it before the marriage and I put all the money down on it. In both names though. I have a 100k a year job but have been out of work since Feb on medical leave and don't know when I'll be returning. My disability insurance only pays be $500 a week. Wife has a good job making 65-70K a year. We have about 10k in credit cards.
My question is does she have any chance on getting maintenance from me?
What about the house. It's lost about 20k in value since the marriage and she didn't put any money into it. Can she get anything out of it?
Anything else I should worry about or look out for?
I'm meeting with a attorney this week and want to be prepared when I get there.
Thanks

I cannot see your wife being awarded any alimony at all.

Do not agree to ANY payments of that nature; if your wife pushes for anything like that, let her take it to court.

What about a lump sum payment? When all said and done the checking and savings will be nothing.
We also have property taxes that are due now. Is she still on the hook for her half?
Before separation we had to borrow 4k from my father. Is she responsible for half of that also?
Thanks

Wow. I thought the question would be, might YOU have a chance of getting spousal support from her due to your illness /unemployment.

There shouldn't be a lump sum payment for maintenance. There will, of course, be a division of all assets and debts. You will each get 1/2 of marital assets adn 1/2 of marital debt.

Nextwife:
I did think about that but I just want her to pay her half of the debt and get out of my life. Thanks for stating that though.

3 1/2 years is really TOO short a marriage for anyone to get spousal support. But she is the high earner right now.

She is able bodied and pulling in over 65K, so I can't imagine any circumstance in which the ill/disabled spouse making LESS would pay spousal support.

Even if he wasn't temporarily disabled I still cannot fathom any alimony being ordered in this case. Its a short term marriage and she makes a healthy wage herself.
