I am being sued for damages to house that I was at.

I was staying at my girlfriends house and I made dinner about a year and a half ago and I accidently caught the stove on fire. I left the stove unattended for a couple of minutes and when I can back there was a fire when I went to put the fire out the fire extinguisher was faulty. The handle broke off. By the time the fire department put out the fire it had reached the ceiling and went laterally and now I'm being sued for $45,000.

If you or your girlfriend had renters insurance, you should be fine. If not, you're going to need to hire a lawyer.

The girlfriend isn't suing its most likely the landlord's insurance company. And it takes a long time for these things to come to court, especially since the repairs have to be completed so they know the final bill before they can even start the process of suing.

I don't have a lawyer or money for one. The state mediator suggested filing for bankruptcy. I have no assests, no house in my name, no car and my bank account is overdrafted.

You may have a defense due to the fire extinguisher not working, but you won't be able to win this fight without a lawyer. If you want to avoid bankruptcy, do what you need to to get a lawyer.
