Good morning, everyone. I have a bit of a dilemma and am not sure how to proceed. Any help or advice would be greatly appreciated. :)

Back in November 2008, I ordered an art print from an online game. This art print was to be directly shipped to my address. To make a long story short, it is 2010 and I have received neither the art print or a refund.

Throughout those ~two years, I have been desperately trying to get in contact with said game's company. I have sent them numerous emails, in-game messages, and private messages via their forums in attempt to get in contact with those in charge. All my dispatches have went unanswered.

In April 2010, I finally decided to send in a complaint via the Better Business Bureau. In May 2010, the company finally responded and said that they would issue me a refund for the art print that had never arrived. The company also told me to send them an email or to message them on their forums so we could talk privately.

I opted for email and the company emailed me back, again confirming my refund (they were going to do a full refund). I agreed and sent them the necessary information back. At this point in time, the company again drops off the face of the earth and stops responding to my emails. I have sent them numerous private messages via their forums as to what happened, but they "ignored" those as well. I know they are active because I see them in-game and on their boards, but they do not respond to any of my requests for help.

In June I updated my complaint to the BBB. The BBB attempts to enter a mediation with said company and sends the company a notification to respond. It is now mid-July and the complaint sits unanswered. Call me paranoid, but I have the feeling they are flat-out ignoring my dispatches and more specifically, me.

Can anyone offer any advice for me? :confused: Is there anyone else I can report this company to, or anywhere else I can go in attempt to get my money back (short of suing)? This is beyond ridiculous. They basically just walked off with my money. I kept copies, screenshots, and logs of all my correspondence with the company from 2008, if proof is required.

My home state is Virginia and the company is located in Texas. I paid via Paypal with the money having been directly taken from my bank account.

I know I should've learned my lesson the first time. This is not the first time this company has done this, specifically with me. I ordered an art print from them before, back in 2007, and went through the same thing. They still haven't issued me a refund nor did I ever receive the darn thing.

Thank you! I was considering this; I really was. I've been reading up on it... The thing is, if they choose not to settle it out of court, there's no way I'd be able to afford going through it in court (like transportation, etc.).

(This is the first time I've ever dealt with real legal issues, so please excuse my ignorance and feel free to correct me!)

They're not a large corporation or anything (they're actually a small business with about 3-5 people in it), and my case would go under small claims. I wonder if they even received a court complaint, would they be more likely just to pay it back, or "play me" and see if I would meet them in court. They seem so adamant on holding my money, I don't even know anymore... :(

If I had the money, I would so totally sue them.

Me too... Why else would they be playing such games with me? It's so frustrating and disheartening. I think at this point I'd have a 50-50 chance of them taking it to court, but if they did, I'd be screwed, LOL.

Is there anything else short of suing that I can do? Anyone else I can file a complaint with or report them to? Anymore BBB-like organizations that help mediate with this sort of thing or that can help get my money back? I tried looking at Texas's Office of the Attorney General, but...I don't know. I feel as if it is not my place. I also looked at filing a complaint with the FTC, but as far as I know, aside from storing your complaint, they don't resolve individual issues. Paypal only does claims up to 45 days of original purchase.

Even if I don't get my money back (ugh...), I at least want them to..."pay" for their misdeeds. Maybe have them get officially docked or cited or something. They essentially stole my money, and that is not okay...
