First-time Ebay seller - can this buyer sue me?

I'm a first-time Ebay seller - recently put my very first item (my brand-new, water-damaged iPhone) on auction after I was pushed in a pool with it in my pocket less than 24 hours after buying it. I saw that similar phones were selling big, so I put it up for auction.

During the auction, a buyer e-mailed me and asked if I would sell to him outside Ebay - me, not knowing how Ebay frowns upon this, called this person and spoke to them and said I would think about it. Then, after hanging up, I researched Ebay's policies on this and decided it would be better to cut ties with the buyer and let the auction end naturally.

The night before the auction ended, I hosted a party at the apartment I'm staying at - sometime during the party, the phone (in the box) disappeared. I know, I know, my bad luck. I must have been an axe murderer in a previous life or something.

Anyway, the next morning, the auction ended before I realized the phone was gone - the top bidder? The previous buyer who I spoke to on the phone.

I sent him a cancellation request as soon as I'd figured out what happened (after tearing the place apart) and he immediately wrote back saying he did not "believe my story" and that he'd be suing for non-performance if I didn't complete the transaction. Since then, I've been writing back and forth, trying to explain and conveying how I hope that, since I'm a first-time user, he can go easy on me and cancel.
He asked if I filed a police report, which I didn't (it was a broken phone that disappeared from a party, it seemed pretty futile to file a report for it, you know?).

Anyway, long story short: I have received NO money for the iPhone (the option to send an invoice still appears). I've explained that I have nothing to send him. Now, he's stopped writing back, but there's been no change in activity on the phone - no payments given, etc. I'm worried he's moving ahead to sue or at least researching his options, so I'm trying to research mine.
(Also, Ebay was not totally helpful - said that I basically had to work everything out with him and encouraged me to communicate only by the Ebay messaging center, so they could keep track of our conversations)

Can he sue me in small claims? What kind of legal recourse does he have? What kind of legal recourse do I have? Again, I have not received ANY of his money and have no item to send him.

I appreciate the responses in advance - I know this is a long, BIZARRE story, but THANKS!!! :)
 


You do still owe eBay the auction fees. Do not send the bidder an ivoice. Send him an email stating that you can't find the phone, and if the buyer doesn't want to wait, then you can mutually cancel the auction.
Do not agree to give them any feed back.

I did open a cancellation case with him, which he then closed, stating (as I said above) - "I do not believe your story".

The Ebay problem resolution center says that I can't open a new case on an item. How may we mutually cancel now?

Also, what do I do if he doesn't agree to cancel? Is there a waiting period? Will I be notified if he tries to take legal action against me?
 
What legal action can he take? :D ;Ask for a refund!
Don't accept payment from them.
Pay eBay the money that you owe for the auction.
Create a new user acount, and disregard the old one. :rolleyes:

Sorry in advance for being so Ebay-clueless (that site is so impossible difficult to navigate/understand), but how do I pay Ebay their fees? If it's for the fixed-auction listing, I included no "Buy It Now" price, so there were no fees attached to list the thing - Ebay let me know that it was free to do so.

And if it's for the Final Value price, how do I pay that if I haven't received any money? I'm perfectly comfortable paying the price and being done with the whole thing, but I don't know how to do it. Will this item just stay in limbo as unpaid and unsent indefinitely? Is there a period of time that has to pass before I can outright cancel it for inactivity?

I'm relieved to hear that he has no possible legal action against me, but I would like to be as active as possible about ending this thing and moving on - I don't want to be checking to see if he's cancelled for the next two weeks, you know?

Again, any advice is much appreciated! :D

Sellers can't neg buyers anymore anyhow.

I wouldn't even ask for mutual cancellation. While this will get you out of the ebay fees if the buyer agrees, he's got no reason to do so and saying no will further jeopardize your relationship with ebay.

Ebay will bill your account. If you don't pay them by the due date, you're account will be suspended.

The listings time out after 60-90 days (I don't remember). But that doesn't matter. You owe the FVF from the time the auction ends with winning bidder. It's NOT deducted from the payment, you owe it from ebay.

Ebay is such a challenging website to find information for and I think, at this point, that's what might have to happen - the buyer sent an ugly message last evening, calling me a "horrible liar" and hasn't responded since (he's usually been very prompt). So, either he's trying to find out how to get back at me or he's just going to let it sit.

Appears to be 90 days, but I'm not sure what difference it makes to you. As I said. As soon as the listing ends with a bid above the reserve you OWE the final value fee. Under certain circumstances (none of which you appear to qualify for) you can get the FVF credited back. Did you cancel the listing while it was still cancellable (not within the last 12 hours)?

Ignore the bidder.
Refuse any attempt to pay, if you get a PayPal payment, just push the refund button on it to send it back.
If they didn't pay via paypal, they can't file any real complaint with ebay (other than to gripe). There's no cause for a judgement against you in any civil action.

PM me the ebay item # (or your ebay id) and I'll take a look.

Simply sign into Ebay. Click on "My Ebay." Then, on "Account." It will show your balance. Move down the screen, and click on: "You can make a one-time payment using PayPal or another payment method."

You can then immediately pay your balance and be done with it.
