What is the name of your state (only U.S. law)? new york

His friend picked him up at someone elses house to bring him home with him.
They were pulled over for the light being out over the license plate on the car. The officer searched the car and found beer that belonged to the drivers father and a bong that did not belong to either of the boys, but another friend of the driver that was not in the car at the time. My son was charged with possession of alcohol and possession of marijuana. We went to court for the 1st appearance and were told that he needed to get a full evaluation for drugs and alcohol. What can we expect next? Should we get a lawyer to help us. We have an evaluation scheduled for August 9th.

Yes, you need a lawyer.

By the way, he was charged with possession (which you said he was in possession) and not ownership of the illegal stuff.

I believe these charges should be dropped as he was not holding on to any drugs or alcohol and was not under the influence of either. He is 16 years old and does not have a drivers license yet.
Definately need a lawyer. Maybe can get the alcohol charge dropped off of there if dad will come in and admit it was his and he accidently left it in the car and they believe him.

You don't honestly believe it was not your son or the drivers bong do you? Regardless when they do the drug test you will know soon enough.

Not sure what him not h aving a license has to do with anything but ok.
