What is the name of your state (only U.S. law)?

WA & OR

Grandma has custody in WA (CPS were involved - heroin use and neglect) of her two grandchildren; there is also an order of CS against Mom & Dad. Mom has a restraining order against Dad preventing him from being around Mom or the kids, but Mom & Dad are recently back together and live in OR.

CPS case-plan is through WA and neither parent has completed the case-plan according to the caseworker in WA.

Three weeks ago Mom called Grandma and told her that "her caseworker" in OR said she had completed the case plan and could come and get the kids back; Grandma has heard nothing from either CPS or the courts in WA and there has never been a hearing or any documentation but allowed Mom to take the kids to OR anyway.

Now Grandma is very concerned that she's been fed a pile of garbage since nothing has been changed through the courts and CPS still have the open case against both parents.

Mom is trying to get state aid for the kids in OR and has told Grandma that if she - Grandma - faxes a letter to Mom saying basically the kids now live with Mom that this is enough to transfer custody.

Grandma's questions:

1. I know I messed up but is it possible that this is right? Could my daughter be telling me the truth even without any court documents or anything?

2. I didn't know Dad was back on the scene - he just got out of jail. Can I force them to bring the kids back if I don't think they're safe? If they refuse is it kidnapping?

3. Is it possible for Oregon to tell my daughter "go get your kids" without anything happening here in WA?

(I can print off the responses and show Grandma)

Thank you so much!

Tisk, tisk tisk... Pro... you should know better. Just kidding. ;)Since CPS placed the children with Grandma, I'd be leaning towards not releasing the children to ANYONE without an order.

That was my first and only instinct, too.

Except the kids are now in Oregon...that horse already bolted :(

I'd be very scared for Grandma... she had custody of the children, she let the children go with Mom, who had had custody taken from her due to neglect and drugs... serious troubles. I'd be hightailin' it to court and to the CPS office... Today! Ok... so not possible, but Monday and get a police report on this! That'd be my recommendation. See ya at the B&G later?

This is just my opinion from what was posted.

Grandma should not under any circumstance send mom a darn thing.

Grandma should call the caseworker and ask the status of the case. How long ago was this? Doesn't the caseworker check up the children at least once a month?

But i got to be honest, if mom did not complete the case plan, grandma should not be expecting the caseworker to have the children returned to her. Grandma messed up.

I completely agree with everyone else. If it was me, unless I see a court order releasing those children, they ain't going anywhere.

There's ain't no "we" Oh wait I'm saving that one for dannyt:eek:

All kidding aside, please give a hug to your friend. Let her know that prayers are on the way.

Oh that is SOOO not good. I think that grandma should consult an attorney before grandma does ANYTHING. CPS in WA had jurisdiction over those children..they are wards of the WA courts.

How old are the kids? Grandma should NOT fax anything to anybody.
