What is the name of your state - Florida
I need advice. I was sharing a home with a gentleman who turned out not to be a gentleman at all...was an abusive drinker etc, and what I thought was a nice man who had asked me to move in a year and a half ago as his girlfriend, turned out to be a frightnening loser. Casting that aside, he broke the lease we shared unexpectedly and without any forewarning, leaving me to carry the entire rent for the house. He works full time, and went to live in his parent's vacant condo for free, and left me to foot the rent, electric, cable, food etc. without any job (I have been unemployed, but have had enough saved to keep paying my half of the rent and was always on time with my portion every month) or means of survival. The total for the bills every month exceeds $1900. I lived on crackers and water for three weeks, have already lost the cable, am about to lose the electricity, and somehow managed to pay the full rent for the past two months, although I am still out of work. The entire situation is an atrocity, especially considering I couldn't do enough for this man, including money I loaned him repeatedly over the past two years when I was working - and I might add, I never was paid back. He left some items in the house and has recently been threatening me he is coming back to get his things and intends to rip out the ceiling fans, tear up the pavers in the back yard etc. etc. while he is here!? I kept calmly explaining that this name is off the lease and the landlord drew up a new lease with just my name, so technically I don't even have to allow him on the premises, let alone in the house. He is violent and explosive besides, and he sank me finacially while he has been footloose and fancy-free doing whatever he wantes and saving his money living rent free. There were three months remaining on our lease, and he should have paid me his portion knowing th eposition I am in financailly at what is the lowest point in my life without a job or source of income - what he did was sneaky and underhanded. My question is - do I have to let him even in the house now that his name is off the lease? I have heard of something known as the Replevin Act which states he cannot even approach me about getting any items he left here at the house unless he files papers in court and is escorted here under the watchful eyes of the police. I would appreciate any advice. Thank you. What is the name of your state (only U.S. law)? What is the name of your state (only U.S. law)?

He us no more entitled to enter your home than I am. He has to have a court order and you could request the police do a civil standby to make sure he doesn't hurt you. Get a roommate ASAP to cover part of the bills.

Did you share a lease with this man, or what.

How about this answer the following, no emotions.

1 who signed the lease,

2 did he give notice he was moving out.

3 what do you want to sue him for.

He is off the lease, he does not owe you for the remainder of the lease term.

He owes you for whenever you paid the full of the bills while he was living there. you can sue him for that, but a jugement does not guarantee payment.

If he comes by, have the police come by too. Let him get his stuff with the police there, you cant withhold his stuff.
