Court order/ lawyer ethics

First: Does an ex have the right to avoid not returning the child to the mothers house if she isnt there, but an adult was there (babysitter). The judge did allowed my friend (babysitter) to babysit and didnt see a problem with it. The court order doesnt state he is allowed, but it came up in court and the judge didnt have a problem with it.

Second: My ex decided to take the baby to work with him instead of returning her to my house after visitaion (he even picked up the child from my friend at my house) becuase he didnt trust my friend. He took the baby downtown atlanta at 7:00 pm to work. Once I called the police and they couldnt do anything about it becuase its a civil matter. He told me he'll met at another building around 1:45am and I can pick up her then. He works with tele communcations. Something to do with hook ups to computers and internet. I doubt a place where a baby should be instead of her own bed in the mid night and early morning. WHAT SHOULD I DO AND WHAT CAN I DO? was this legal?

Third: We had to have the signed court order redone becuase his lawyer put extra things in the first one and got it signed by the judge by decieving himm into thinking both parties agreed. The judge approved of us redoing it, so we did and his lawyer hasnt confirmed the new order yet and its been 7 weeks. The judge wont sign it unless both parties agrees. My lawyer keeps telling me to just wait and it will be fine, but in the mean while, he is still following the old court order. When is reasonable time for a lawyer to have this done in the court system?

Is my lawyer doing his job and should I find a new lawyer?

After one of my many custody hearings, my attorney brought me the visitation order to sign and I refused to sign it because Dad`s attorney had added some (a lot of) extra time to it. They had to go back and listen to the tapes from court to see that I was right about what we actually had agreed to in court.

Unless specifically addressed in the court order, yes - Dad has the right to insist on handing the child back to the other parent.

Legal, unless otherwise addressed in the court order. Doesn't make Dad look too hot necessarily, but you also shouldn't have called the police over something like this either.

Sadly it CAN take weeks to get these things done.

I'm going to offer a bit of practical, not legal, advice here.

Pick your battles. You're going to be dealing with Dad for a long, long time to come...and if you're already challenging Dad's actions (calling the cops because he took the child to work with him instead of leaving the child with a sitter he didn't trust? Really?) you have a long and rocky road ahead of you.

Effective co-parenting means you have to have some give-and-take.

How old is the child, incidentally?

Where were you during the two incidents involving the sitter?

The simple solution to the babysitter problem is to always be home for the exchange of the child. Then dad will have no reason to question anything or do anything as foolish (in my opinion) as taking the child to work.

If he is traveling around hooking up computers and internet he could seriously get into hot water with his bosses for taking any child with him, let alone an infant.

And, if so, then both incidents have been discussed in front of your judge, correct?

The old court order is what everyone should follow until the newest one is signed by the judge.
