I have been living with a man as his girlfriend for over a year and a half, and we were sharing the rent on a home splitting the monthly payment in half. He turned out to be an abusive alcoholic and although I should have contacted the police on many occasions for domestic violence, I chose not to do so because I felt sorry for him and his dependancy on his addictions. I was a fool and I do realize that now, but the advice I am seeking is not related to those issues. As miserable as the relationship became due to his problems, I still tried to maintain my composure and hold it "together" thinking it would get better, and I was still very good to him always willing to give him money because he always claimed he didn't have any. I paid my rent on time every month, and was never late once, iin contrast to him being one to two weeks late evey month although he had a full-time job. Which brings me to my point - as of last year, I found myself suddenly unemployed due to monetary cutbacks (I am a teacher), but I still continued to pay my bills on time and never asked for any assistance. Then, suddenly and without any forewarning, he broke his portion of the lease to go live in his parent's vacant condo for FREE, and left me with the full rent and electric and cable - a total of over $1900 a month which of course I was unable to afford. I had barely been able to pay half the rent and half the bills, but to double the amount was just something I was nowhere near in a position to do being unemployed! Again I mention, he works full-time and earns an excellent salary. When he left, I literally starved here in the house living on crackers and water for a month just to be able to pay the full rent. He meanwhile bought himself a motorcycle and continued to live both problem and rent-free. His portion of the lease was due to end on August 31st, and I want to sue him for the last 3 month rent (his portion). Because he broke his share of the lease, the landlord held his deposit and now he is claiming, "Go ahead try to sue me for the money, you can't do a thing because I left the security deposit on the house for you, you f-----g b----h" , which is of course an outright lie, it was the landlord who refused to refund his security because of what he did. Two days after he left, the landlord had me sign a new lease with just my name on the lease fo rthe next year. Yes, I signed because being unemployed I can't get approved to live anywhere else right now, and I have also invested a great deal of money into the house over the past year for upgrades etc. MY QUESTION IS - CAN I SUE THIS CREEP OF A MAN AND BE AWARDED THE MONEY I HAD TO PAY FOR HIS HALF OF THE RENT FOR THE PAST 3 MONTHS?? I want to come out of this on top, not looking like the fool I look like now and it was disgusting enough what I tolerated while we were together, but besides that now is the fact that there is simply no justice in the fact that he just "walked" and left me holding the bag while he earned and saved his money and is enjoying life while I am struggling just to see the forest through :mad:the trees. What he did to me was so cruel, and it was never deserved. Can I sue him and win????

Hi - yes, I know it may appear to be the same thread but it's slightly different in that my prior thread asked whether he was able to come back here and claim he can enter the hose. My recent thread asked if I can sue him for the back rent and win. Yes, I am very upset and I don't have anyone to turn to for advce and only received one answer to my post earlier today. It will cost me $175.00 to take him to court, so I need to be absolutley positive it will be worth my while before I proceed. Do you have any advice for me? It's been a rough few months, it's been sheer hell for me and I want that money back from him becuase I put up with so much when he was living here, and by all rights I could have easily put him behind bars. But I am so sikeningly sweet I just couldn't do it. Guess stupid is more what I am.

Not if he was written off the lease when he moved out. If he lived there, and you paid his 1/2 then you can sue him for that. Maybe you can get one months' half for lack of notification... maybe.

You can sue him, but you might not win that much, and that does not guarantee he will pay you.

Same old problem ... living well beyond the means and it has come full circle. Tons of these places in Florida today.

OP has no recourse and signing a new lease ... well what can I say.
