What is the name of your state (only U.S. law)? Texas

With a 6 hour ROFR in place, can I be forced to release my children to their grandparents prior to their mothers return from out of state, assuming she is/will be back in town within 6 hours?

That is the shortest way I could sum up the scenario...

No, ROFR only applies to the parent. If the other parent is unavailable, you are free to find other child care.

However, is there any reason that you are uncomfortable leaving the child with the grandparents? If there's no good reason not to, I would just do it. Being flexible goes a long way.

Thank you... but I do not need other childcare. I'd like to keep them with me until she is available to pick them up - we all live in the same neighborhood.

The other part of this issue: She emailed a request for me to watch the kids from noon 8/12 through noon 8/22 two months ago. I replied that I can pick them up at 6pm 8/12. As of today, she's insisting that I pick them up at noon on 8/12 knowing I'll be at work. Since her paralegal handles every email and/or correspondence to everyone for her, they again have something up their sleeve. I'm just not sure what it is yet.

After 2 1/2 yrs of their games, this isn't paranoia, it's experience.

You are free to stick to the letter of the agreement - as is she.

ROFR means "right of first refusal". If you cannot provide the care, you are not required to do so. If you cannot provide the care, she is free to find someone else to do so.

However, I am more a little confused. She asked you for a specific period. You cannot provide care for the entire specific period, only part of it. Are you going to be working during that period of time? How do you know that mom won't be back by noon on 8/22?
