My 17 year old son was pull over by the police. They said my son was pull over because they believe he was careless driving and he was in area known as a drug dealing location. Which was just next town over from where we live. Both areas are upper middle class areas. I never knew that the area was a drug place.
However, that was not the case. When they approach my son, he had 2 other passages with him in the car. One 18 and another 16. Without the police officer explaining why he was pulled over, the officers right away said everyone out the car. They right away place handcuffs on all 3.
The car my son was driving, was register to my husband. So they took everything apart inside the car and search all over. Now on the 18 years old and 16 years old, both was carrying weed. One carrying one that was half smoke that was left in the bag for days and the other was carrying 1 nickel bag. Which was found in the school bags they own. They never found anything on my son.
They brought all 3 to police station and questioning them all, Then forcing them to sign something, they did not know what they was signing. Until today, they do not know what they sign. All 3 teens was not allow to call their parents and was told they need to sign papers before any of the parents can be call. But this case did not apply to the 18 year old friend. Rules was different.
My son and his friends was at the police station for over 3 hours, and was not allow to call home. All 3 teens was handcuff all that time and my son was told he was not even allow to go to the bathroom.
Over 3 hours later, is when we me and my husband got the call. The officer told my husband they do not know if he will be charge or how the Juvenile system will look at this. The officer said i see your son has a clean record and never been in any trouble and Juvenile system may be more easy when dealing with my son.
The officer never mention anything about any ticket or him going to court. Keep in mind this happen on a Friday 07/31/2010. On 08/03/2010 the 18 year old was sent a letter stating to appear in court on 08/04/2010.
However, my son they got anything. While my son friend was in court, the friend notice my son name on the list for that day to appear in court. However, we never was told about any court date. So his friend call him right away and told him. So me and my husband call and confirm this and we was told he needs to be in court right now or they will issue warrant for his arrest.
So we all went to court with my son. To be told by the judge that day, he needs to go in front of Juvenile Court, before he can be heard here. When calling the Juvenile division for town and county, they said his name is not even in the system.
When we got home yesterday from court, we saw the letter to appear in court for the same day we receive it, the court day was listed on the traffic ticket. We look at the stamp and notice it was stamp and mail on 08/03/2010 and we receive it on 08/04/2010, the day of the court hearing.
Can they give you less then 1 day notice to appear in court?
Was his Miranda rights violated?
Is it strange for him not to be in the system?
My son is set to be 18 in 2 weeks, would they be waiting for him turn 18 and charge him as a adult?
Do they have a strong case against my son?
Why wont they talk to us about the case? Knowing we are his parents and we are told wait for the court hearing?
What can I do now to help my son now?
