What is the name of your state (only U.S. law)? CA

1. Mom moves with child out of country permanently to a third world country.
2. I want to file divorce without her presenting (she can not come because she can not enter USA legally).

Does the child support order will be the same as she and the child living in CA? Or it will be adjusted to the low expenses in her country?

When did she move? The US may not even have jurisdiction any more.

In general, CS allocated by a state will follow that state's guidelines. If there's a reason for a discrepancy, most states will allow the judge some leeway. For example, if you're ordered to pay 25% of your income, but that's sufficient for her to live like a queen in Nigeria or wherever she is, you MIGHT be able to get a lower amount, but it would probably depend on the judge.

I'm guessing that this might be complicated enough (with service issues and so on) that you may need an attorney. You should at least consult with one.

6 days ago your wife, child and your mother in law were all living in your rented home in CA. Also, as someone else said, according to your previous posts your wife has a green card.

Did they just leave for Uzbekistan (did I spell that right?)?

You can not come back to USA with a green card if you are more then one year abroad. And she is not going to come back because of this issue and because of some economical issues also.
They are going to leave soon, i left the house because i was attacked by her mother.
And yes, i am very care for the child, but i don't want that all her family will live on my child support.

You're putting the cart way before the horse.

(And in some circumstances you CAN obtain a special waiver to enable you to reenter the US after you've been absent longer than a specific period of time).

If your child support ends up being enough that her family can live on it - so be it. That's just how it goes; you cannot choose or dictate how its spent.

Alex, what's wrong in giving your child what will be considered an exceptionally fortunate upbringing?

Are you more concerned with punishing Mom?

(For those interested the current exchange rate is 1,000.00 USD = 1,626,000.00 UZS - I'll pop back and post a comparative cost of living thingy)

Whats wrong? I prefer to save this money so he can study in USA in a good college.
