What is the name of your state (only U.S. law)? PA
Good afternoon, I live with my fiance & we're in the process of breaking up. He's broken my trust by inviting another woman into our home without my knowledge & consent. I've found things askew @ home (you know how you leave things before you leave home), articles of clothing, her using my hair products, pictures, emails, etc. In July we re-signed our lease for another year after he said he wouldn't re-sign. He won't leave & I won't leave, not to mention we have nowhere to go. I've spoken to management about moving to me to another apartment. In July, they've stopped accomodating tenants requests to move to another unit, with the exception of emergencies like, fire & water damage. I no longer feel comfortable here. Is there any legal way I can have him removed or force management to reconsider moving me to another unit?
On a side note, we are 2 months behind in rent. In October we will be going to court to make payment arrangements to pay the back rent. Thanks in advance.

**A: the management is not going to consider accomodating you since you are behind on your rent.

When you are evicted for non payment your problem with living there will be solved.

Other than that, he doesn't have to leave, and you cant make him. You can leave, but you will still be responsible under the lease terms you signed.

TMI - too much information about your relationship. 2 months behind? I'm surprised you haven't been evicted. As other member stated, mgmt certainly will not accommodate the request of someone because her bf is cheating and esp since you're benind in the rent. Move in with a friend/relative if you're so uncomfortable.

You suspected your fiance of infidelity, yet you still signed a new lease with them for the apartment in which you both reside? That was a BIG mistake on your part. You are BOTH a party to the lease. That means neither one of you can force the other one to leave (you don't have the authority to evict a co-tenant, only the LL has that right).

The LL also has no obligation to resolve your personal issues by allowing you to move separately into a different rental unit. Your discomfort is a situation of your own making by agreeing to sign a legally binding lease along with the person whom you now wish to live apart from. That is not the LL's problem, it is YOURS and YOURS alone.

If you guys are 2 months behind in your rent payments, that means that your living situation is likely going to be resolved very soon - by evicting BOTH of you for nonpayment of rent. I suggest you take care of yourself and find somewhere else to live because despite you having no place now, you'll need somewhere to move to once the eviction process is finalized.

You should get your own place ASAP. Once the eviction goes through you won't find many that will rent to you. If you can get up the money to pay your back rent and move out to a new place asap would be your best move. Get your boyfriend to move out of this apartment as well. You may avoid a eviction on your record.
