What is the name of your state (only U.S. law)? tx
I had 3 huge losses a couple of yrs ago and trying to find if i have case against my broker. The largest was in live cattle. I had 25 contracts for a total margin of $27,000 and a maintenance margin of $20,000. The broker did not close this position out until I had a loss of $85,000. The other 2 were not as bad. I think my broker owes me at least $60,000. I think this is a case of execution failure. What is the answer?

Your margin maintenance requirement amount is not stop loss order.

Nor is an stop loss order a hard cap on total realizable losses on a contract, trade, or open position.

You were trading a volatile market commodity, and your brokerage agreement would have made you contractually aware of the potential for unlimited downside risk.

You badly did not understand your margin account agreement if you thought your exposure was limited to you minimum maintenance requirement.

You waited two years to decide to take action. Better think up a good answer if you decide to go to court.
