What is the name of your state (only U.S. law)? Georgia

Mom - primary custodial parent
Dad - secondary custodial parent
Divorce - 2006

"The parties agree that they shall at all times confer with each other on all important matters pertaining to the health, welfare, education, and upbringing of the minor child of the parties, with a view towards arriving at a harmonious policy calculated to promote the child's best interest. In the event the parties are unable to arrive at a mutually agreed-upon decision, they shall submit the ,atter to arbitration. The Husband shall select the arbitrator from the *** County Court Annexed Domestic mediator list or the *** Group panel. The parties shall equally share arbitration expenses."

So, if the Dad disgrees with Mom (yes me) is he the one responsible for filing to seek arbitration?

If you cannot agree, it says you will both (they) submit the matter for arbitration. Dad gets to pick the arbitrator and you both will split the expense of said arbitrator.
