What is the name of your state (only U.S. law)? MS

I am recently divorced and my ex husband is staying in the house while we try to sell it. We have a mortgage on it in both our names. He is ordered in the divorce papers to maintain the house and make the payments until it sells. I own another house free and clear in my name only. If my ex were to forclose on the marital home, could the mortgage company take the paid off house from me?

**A: please get your terms straight. The lender forecloses not your ex.
The quick answer to your question though is yes, through a legal process through foreclosure, getting a judgement, then using that judgement to foreclose on your other house.
