Water damage do to contractor not properly installing shower

I had a tile shower put into my house 2 years ago. I noticed i had a lot of standing water and it did not drain right. I never thought much of it. Finally i started see water damage to the base board. I called the contactor and he said it had been over a year and he would not fix it. I got another contractor to do the shower once he started taking it apart he said it was not proper installed. The cement slab was soaking wet and damaged the studs. He said if we would not of caught it when we did it would be way worse. My question is since the shower was not installed right can i claim the damage on home owners insurance? Like i said the second contractor said it was done no where near right.

Why don't you take the first contractor to court?

i was afraid the legal fees would be more than having it re done. do you think i could claim on ins?
