Ex threatening parental rights

Hx: My son had a child with a now ex-girlfriend 11 years ago. His name was never put on the birth certificate but he's had a Missouri court-ordered child support agreement with her for about 7-8 years now and it is deducted from his paycheck. He never got a lawyer to grant him visitation or change the birth certificate but until a year ago was voluntarily given visitation. Now that the ex has a new beau and child, she's cut off his visitation and is threatening to force him to give up parental rights so the new boyfriend can adopt. Other than a DUI, the biological father (my son) has no criminal history or history of domestic violence and has refused.

Here's his question. Since his name is not on the birth certificate (father listed unknown), can someone else adopt his son in spite of the Missouri child support order?

His plan is to hire a lawyer when he has saved the money but is concerned something could happen in the meantime.

heres the answer. No

your son should go to the court that issued the CS order and file for visitation today. he does not need a lawyer, there might not be any filing fees. If there is a filing fee it will be considerably less then hiring a lawyer at this point.

since there is no order in place, mom could withhold child from dad, until there is, so it is important he file ASAP.

yes- he needs to file for visitation BEFORE she files for adoption. He should be able to do that himself at no/low cost by contacting the county where the child lives.
