Say a parent were to report unlawful sexual contact between a minor of 16 and an adult of 21. If when questioned both parties claim there is no intercourse taking place, can one still be charged? Charged with what?

With the little information you provided, no. A DA is not going to take he said/she said case without other evidence. If you have other evidence such as emails or text messages that indicate the presence of a sexual relationship, then you might certainly convince a DA to look into the case.

The adult can be charged with a felony violation of PC 261.5 as well as other offenses, depending on the details.

If both parties deny the relationship, mom and dad can still seek a restraining order against the adult and the adult might still be held accountable for other charges such as contributing to the delinquency of a minor (assuming that the adult is aiding or encouraging the minor to disobey his or her parents).

The bottom line is the adult can face some serious consequences - including prison time - for engaging in this relationship.

I did for a while i ended up working things out with my mom. I'm worried about my mom getting my older brother in trouble for hanging out with my friend.
Well, good for you to work it out with your mom.

It is my serious suggestion that your brother stop hanging out with your friend, for another year or two.
