Mom may have gone about it the wrong way. If I were you I would have a talk with Mom about finding a provider in network which would reduce costs. If this should go to court, it is very possible that the judge would order counseling and the decision as to whether or not they need counseling would be moot.

There is no good reason not to go ahead with counseling. If the counseler feels the kids are adjusting well and not in need they will probably say so.

The biggest problem I would have would be the choice of an out of network provider which in the case of an HSA could increase your copay drastically. (I hate HSA's and HRA's, but they are the wave of the future. Anything to get the member to be more "fiscally responsible")

I would also insist on meeting the counselor before choosing one. And check up on their history (the attorney probably has an idea). Some counselors are 100% for getting children with their mother - or vice versa - or have other biases that may not be ideal.

Appreciate the suggestions. I may give my other son's psychologist a buzz and schedule a session just to get a 2nd opinion. He's familiar with the two boys since I'd bring them with me for my son's counseling. Don't recall if he ever spoken with them privately, and if he did it was about their brother not any issues they might have had. Plus it would be nice to have him see my oldest again as he's shown considerable progress since the last time they spoke [improved grades, off meds].
