1 Person per bedroom violation?

What is the name of your state (only U.S. law)?

Basically the management, Cola Property Management in SC says only 1 person per bedroom in all of their units.

My question: What if a friend and I sign the lease and my girlfriend ends up staying the night all the time and keeps stuff there a good bit, does that break the contract. I mean she would basically live there, but would use a parking space (which i feel like is a main reason for their limit) also it would not cause more of a ruckus. Also, the place would be well taken care off if that has any effect on the answer/reply.:)

If it is wrong to do, would they find out?

If it is wrong to do, whats the punishment?

The LL/management has a right to know about ALL occupants within the apartment that they rent to you. If they have limited your rental to one person per bedroom, and you add your girlfriend into the household, you are doing so without authorization and this is a lease violation. It doesn't matter whether or not you agree with the management's rules, you agreed to those rules when you signed the lease. It is definitely wrong to do, and the punishment could be that you and your friend end up getting evicted for having an unauthorized occupant in the apartment.

Tell your girlfriend to spend the night at her own place. Better yet, why don't YOU start spending more time over there instead of putting your friend and leasemate at risk of eviction?

Alright. Keep in mind it was a what if question. I have yet to sign a lease with any place. The sad thing is that many properties are run by this management and have such limitations. All of cola management property are limited to one person per bedroom, which is unfortunate because it is difficult to save money when money is tight.

Thanks for the reply I just needed some reassurance on the topic.

Move in with your girlfriend; get an apartment together that's not run by that company. People do it all the time.

so, a married couple can't rent a 1 bedroom unit? Or if more than a single bedroom, they can't sleep in the same room?

Strange rules, very strange.

Here's my take on your questions...

If you sign a lease or rental agreement that says only 1 person per bedroom, then you have agreed to the terms and conditions.

If your GF stays the night, and to quote you "I mean she would basically live there"--well, gee, if she is living there and her name is not on the lease and she is not the sole person who is supposed to be in the bedroom, then you are breaking the lease.

Yes, it is wrong to deliberately try to get around the terms and conditions of your lease. Yes, they may indeed find out.

The punishment? They could serve you with a notice to Cure or Quit, they could serve you with a notice to evict immediately (usually within 3 days) since you are in violation of the lease, and this would affect your reputation as a good, reliable, honest tenant because when a future landlord does reference checks, this is likely to come up and while you may be a good & reliable tenant (clean, quiet, pays rent on time), your trying to lie and finagle your way around the lease agreement doesn't show honesty or integrity or character. I'm not sure that's the person you want to be perceived as but that's JMHO.
