What is the name of your state (only U.S. law)? virginia. hello,i went to the tax service,to apply for a tax loan, using my last check stub.they told me it would take 24-48 hours, a week went by,and i recieved a call from the company they told me my card was available. i ask over the phone how much would i get,he said come in the office. i went down to the office they said i was denied the loan,but they would give me 100 dollars as a gift,i told him that i didn't want it because i needed more than 100.and that they wasted my time.The man told me my taxes was ready to be e-filed on the 15th. i told him that i dont want them to do my taxes. he said it was to late. i told him he does not have my permission. can they do that and can i stop them before they do. they don't have my w-2 form. they just using my last check stub.sry so long. i am just upset right now.

I suspect you signed a contract for them to prepare your taxes, along with the loan application.

Read your paperwork carefully.

no i did not sign a contract. i gave them my check stub they gave me an estimate. they said i would have to sign when i pick up the loan. but the loan was denied,so they offered the gift of 100, if i took that 100 i would have to sign a lot of papers to get it. i told them i don't want it and he said it was too late.

Have you already received a copy of the return and did you sign an 8879?

Refund Anticipation Loans are problematical from the IRS viewpoint and there is litigation over them. (Mostly from the preparer not now able to check with the IRS if there are any other taxes which will reduce the refund.) From a personal viewpoint, they are very expensive money. I don't think you'll get your money any faster from any other route. Take the $100 now and get the refund when it comes. (Depending on your circumstances, it may not be able to be filed until mid-February at the earliest in any event.)

I don't see how they can run a credit check without your signature.

Its actually against the law to use a last paycheck stub to do a tax return, and against the law to tie a tax return to a check stub loan.

The tax preparer is lying to you that you are stuck doing your taxes with them. They cannot file a tax return for you without your signature on an 8879, and without a copy of your W2. Feel free to go somewhere else to have your taxes prepared.

You could also report the preparer to the IRS.

Credit checks don't take signatures. All I need is your social.
Obviously, I don't run credit checks.

OP can always call tax service and tell them that he forgot about that part time job he had in the beginning of the year, and he's waiting for the W2 from that one.

I also suspect the $100 'gift' is only good towards tax preparation services.
