My employer is claiming that they mailed my paycheck. It''s been 10 days since pay day, and ofcourse the mortgage was due 10 days ago. I still work for them . They mail the checks from out of state. What are my options please? :mad: Yes I had direct deposit, I changed banks, and they claim it takes two pay bi-weekly pay periods to start the new bank deposit.

Well, they can have a waiting period for a lost check. You'll just have to wait. As far as your bills are concerned .. its really not their problem, its yours. You should always have ~3 mos. of expenses saved in your bank for such issues that arise.

So, the employer is doing nothing wrong even though it is causing you some distress. You can pay the mortgage with a credit card? Its better than nothing I guess.

Or a payday loan?

And, it is not unusual for a new direct deposit instruction to take a a couple of pay periods to become effective, due the employer choosing to do a pre-notification transaction. One payroll for the pre-note, DD effective next payroll.

So, when do they say they will stop payment and replace it?

They said replacement right away, but it's not a lost in mail situation. How many days, months should I wait before I ask a lawyer to call them? :(

How do you know it wasn't mailed?

How long has it been since they said "right away"? Are you in the same location as payroll?

I believe the check will always be in the mail until there is nobody there anymore to ask where it is. I've had this happen before, show up on Monday and it's dark inside, nobody can get in, and the last check never arrives in the mail. That's why I want to know the limits. :mad:

Whatever. So, how long ago DID payroll say "right away"?

You can certainly file a claim for unpaid wages with the state DOL if you like. Just saying that it will be at least several weeks before the DOL even gets to working your claim.

I requested the replacement after it was 10 days late, and it's been 2 months, and no replacement has happened. Do I wait 90 days, my bill collectors are waiting 90 days to be paid.
