What is the name of your state (only U.S. law)? Oregon


I have requested for 3 weeks now to have the LL send our lease paperwork and all of our receipts from all of the payments we made.
She keeps telling us that she will email them but she has not even done that.
We asked her to mail them or drop them off not email.
If we don't have any of the paperwork or any of our receipts for the payments we made on the house or for the security deposits, we are pretty much screwed aren't we?
I should also mention that she has told us that she has to say she lives there due to some bank loan she has on the house.. i dont know.. seems kind of strange to me.

Are we still obligated to pay or can we break lease and move out if she is refusing to give us copies of anything?


We have been living in the house since November.
 


well, you made an error in not getting a copy of the signed lease to begin with; the LL does not have to give you a copy now.

She should give you receipts for your payments.


Owner-occupancy has ramifications with banks & IRS.

Send a written letter to her asking for copies of what you like (did she ever give you payment receipts & you lost them? if so, she does not have to give you any copies--heck, she may not even have copies to give).

You are still obligated under your lease.

I ask I ask I ask .... I wrote I wrote I wrote ; which sounds better?

She is using the house we are in as her address and will not give us an address for us to send her anything at. So we cant just mail something to our address with her name on it can we?
Since she doesn't want anyone knowing she is renting out her house it's kind of a pain to get any information out of her.

She had us sign the lease then told us she would make copies when we first moved in and we never received them or the receipts for anything.
Meaning if things got ugly she can say we never paid anything.
We have now been asking for 3 weeks for both and all we get from her is "I will email them to you" and never does email them.
We have asked and asked many many times for her to mail us hard copies.

Not sure what else to do.

Of course you're still obligated to pay rent and this does not give you justification to break this lease legally.

Pay with check or money order and this will be your receipt that rent has been paid.

Yeah I figured that much and planned on doing it that way from now on.
Just trying to figure out how to get a copy of our lease.
She said we would get copies and now it just seems like she is avoiding us.

If you move out (breaking the lease), I bet she'd be able to produce the copy...

Don't understand why people don't get a copy of the lease at the time they sign it and get the key. It's easy to go to a library or Kinkos or UPS store or CVS or the grocery store with the landlord and make a copy. I've seen all kinds of excuses, but never a good one.

As far as receipts - if you pay rent in cash you should insist on a receipt at that time or the money should not leave your hands.

Obviously you didn't do either of these things so you made your own problem. Landlord will keep lying and ignoring you. There is no way we can tell you how to make her answer her phone and give you what you want. Your calls to her are a waste of time. You could try just showing up at her door, but she mosy likely will blow you off.

As for the receipts, yes I screwed up and didn't get copies at the time. That I will talk fault for but what kind of LL would not give a copy of your lease after you sign it? and not make repairs to the house when it needs to be done, or doesn't want anyone to know she's renting out her house? Tax reasons? banking reasons? or just plain being a slum lord...

Yeah I can take fault for a bit of it but come on now..

As I said, I've never heard a good excuse. I find it hard to believe tht there was not a place where you two could have gone to make a copy. Most businesses have a copy machine and would have made a copy for you, so don't give me that "Kinkos is 40 minutes away" excuse.

Actually it does matter 'what you didn't do' because now you're in a predicament and you made your own problems by not acting responsibly. But it's obvious that you don't comprehend that and just want to keep pointing the finger.

Well, if they are good enough excuses for you to use to explain why you didn't get copies right away, then they can be good enough reasons for the LL to not provide then to you in what you might consider a timely matter.

Perhaps the LL hasn't travelled the 35-40 minutes to the town that has the only copy machine in a 100 mile radius?

And it doesn't sound as though the LL is refusing you....merely delaying it.
