What is the name of your state (only U.S. law)? PA

I live in MD but my CSO is out of PA. I had a telephone conference requested by NCP to reduce his monthly support obligations. In the hearing I agreed to have the monthly amount reduced but asked them to leave the medical reimbursement the same. $250 is what I have to be responsible before NCP is responsible for 50% there after.

I was getting ready to call Enforcement because he hasn't paid anything since May of 2010. I just realized that on the most recent paperwork, dated 11/22/10 that the clerk removed all medical expense responsibility from NCP.

I have NO idea why they would do this. Our son's med out of pocket expenses exceed $3000 every year. I would NEVER agree to that, ever!

Am I just SOL? I have an attorney for my custody matters - but I can't really afford him for CS issues too. Is this something I can try to correct myself? Or do I need representation? I am on hold with my CS office now, but I could be for the next 45 minutes or so. I would like to be somewhat prepared of what my options are.

The NCP only has to follow the support order. He owes only up until 11/22/10 and nothing since then so you have to file for a modification if you want him to be responsible for medical expenses.

That's what the customer service rep said also. She did give me the number to fax a request for reconsideration because in the order dated 11/17/2010 it states:
The monthly support obligation includes cash medical support in the amount of $250 annually for unreimbursed medical expenses incurred for each child and/or spouse. Unreimbursed medical expenses of the obligee or children that exceed $250 annually shall be allocated between the parties. The party seeking allocation of unreimbursed medical expenses must provide documentation of expenses to the other party no later then March 31st of the year following the calendar year in which the final medical bill to be allocated was received. The unreimbursed medical expenses are to be paid as follows : 0.00% by defendant and 0.00% by plaintiff

X Insurance is not ordered and/or no current support obligation exists
The last sentence is incorrect because the previous order before this one dated 7/20/2010 read

Unreimbursed medical expenses that exceed $250.00 annually per child and/or spouse are to be paid as follows: 50% by Obligee and 50%by Obligor. The Obligee (me) is responsible to pay the first $250.00 annually in unereimbursed medical expenses.
NCP must also be unaware of this change because I have been sending requests for payment via email and he's acknowledged that he owes me these monies. Will that hold any weight to show that this was something neither one of us agreed to? NCP is very unhappy with his support obligation completely. He would have been all to eager to point out that he no longer was responsible for sharing the med expenses :confused:

Who has insurance on the child? Is it state insurance? It may show that you have an agreement. But how much weight it will hold depends on the judge.

My husband carries the insurance for my son. Dad had insurance but then it was terminated May or March of 2010 and he never provided me with a new card. I don't know if he has insurance for him or not. He wasn't very forth coming on any insurance info at the hearing in Nov. He said he has insurance but he won't get the card until after Jan 1, 2011. That's where I said that I would be the responsible party to carry the insurance and he would just continue to reimburse me like he has in the past. Which always meant contacting enforcement to garnish his wages because he never has paid voluntarily.

I don't know if it's relevant, but currently I have primary physical and legal custody of our son. There is no ordered visitation schedule. It's not like a shared custody agreement where we would be responsible for the med expenses incurred during our visitation times. I would be surprised if Dad ever has taken our son to any type of medical appointment in at least the last 6 years.

They fixed it :)

I got an updated order in the mail yesterday that now correctly states that I am responsible for carrying the medical insurance and Dad is responsible for 50% of the med expenses after my $250 and it was made it effective 10/22/10.

I am pleasantly surprised that this was relatively painless and fast. I am afraid to get used to it though ;)
