Will I be Sent back to juvy?

Hi, im 16 and I was kicked out of school and sent to juvy by my parents for pulling the fire alarm at school. I just got back to my base school 2 weeks ago and am now recommended for expulsion for bringing a needle to school which is being considered a weapon. Some girl took the needle out of my bag and was stabbing people with it, she's getting charges pressed against her by parents and is going to juvy. I go to court I'n a week for pulling the fire alarm. When I got back to my regular school my grades were are all A's and two B's. Will the judge send me to juvy since I got kicked out twice? What can I do to lower this chance? This is the only trouble I've ever been I'n.

I'm sorry but most kids don't get into the kid of trouble you're in so to say "this is the ONLY trouble I've ever been in" is still a lot of trouble.

You didn't learn from your first time in juvi. If you go back, maybe you'll think a little harder before breaking the law again.

I didt realize it would be considered a weapon. Many kids at school have buttons and safety pins with them,. What's the difference between that and a needle? I'm not a bad kid. 3.5 gpa. I just made a stupid decision during
Homecoming week. I honestly did learn my lesson the first time, I didn't think a needle would be considered a weapon when everyone at school has them all the time.

How did "some girl" get hold of your bag, and how did she know you had a needle in it? And... are we talking about a sewing needle, or a syringe?

I think the problem is going to be that your PARENTS felt you needed to be in Juvy for that first offense. Parents of a kid who has never been in trouble don't tend to make that their first reaction to a transgression. So... I have to wonder what the rest of the story is. Or is this just the first time you were caught? Are you difficult at home? Don't do as you're told? I suspect there is more going on with you than you've admitted, hon.

One thing you can do that may help you is that when you appear in court, you are quiet, respectful and behave maturely. DO NOT whine, cringe, blame other people "she got it out of my bag" and "..other people bring stuff all the time...." because this sounds like typical juvie garbage.

"It's not mine, it's not my fault, gimmee another chance, this is ALL the trouble I've been (caught) in so far".. Those are the type of things that the judge hears all the time.

You need to go in with the attitude that yes, it was mine, I made a mistake. I used bad judgement, but I realize that now. I am ready to do better and change. I have the capability to make good grades, and I am ready to go back to my regular school and stay out of trouble and get my life straightened up. I understand that I will probably have to change a lot of my behavior and to probably get a new set of friends to hang around with. I do not have a drug or alcohol problem that I need to work on. (This, of course will be something your parents would have to verify.)

This might help you, while all this blaming and whining about what someone else did to you and all the rest of the people were doing it too will NOT.

I'd lose the "probably" part of those comments, though. I would state that you NEED to change your ways and your set of friends and what you are doing to make that happen.

Hint: Joining a service organization (i.e. Key Club) at school will go a long way.

My patents said that they sent me to juvy the first time because I was starting to get an attitude with them. My moms a major pothead, that's all she cares about, I try to just ignore her and when she's screaming for no reason I go I'n my room and she comes I'n and keeps screaming and hits me until I try to leave then she threatens to send me back to juvy. No it wasn't a syringe. It was a very small sewing needle. I really feel that I shouldn't have to go back to juvy because staying I'n a room over there for two weeks is just gonna make me depressed. I've already been I'n the hospital for things I've done because of my depression. I think community service would be best A's it would give me something to do.

Ooookay - so what have you done due to your depression? (And note - it makes us wonder why you're only now mentioning this. Because it is obvious that it is NOT the first time there have been things going on with you.)

My moms been I'n the mental hospital multiple times, she's literally crazy and it's impossible to deal with her. Ignoring her only leads to her screaming directly I'n my face and hitting me. I've never hit her back, only pushed her off of me. I had started cutting myself about 3 years ago. I've stopped that. I don't do drugs. I don't understand why everyone is thinking I'm a bad kid. I make good grades and I don't go out and smoke weed at the mall like most kids I know, I'm home all the time, the fire alarm and needle is the only real trouble I've been I'n. I mean I've been punished for a bad grade here and there, and I've been punished for things that have happened with my mom, but that's about it.

I have had experience with parents who actually think that having their child put in juvenile gives them a disciplinary tool, a threat that if the the child gives them any more trouble, and they go back to the judge, the child will go back to juvenile.

Unfortunately, unless your mother is so bad that you think the foster care system might be preferable to life with her, she has that edge on you and can hold this over you until you age out and can leave on your own. And you are not there yet. So what you need to do is rehabilitate yourself. Do your utmost to get along with her.

While it is okay to explain how bad she is to us, how she is mentally ill, treats you abusively and smokes pot, whatever, which may or may not be true, what I said before still goes about what to say in front of the judge. You must convince them that you are mature, responsible, and that you understand and take full blame for the previous troubles you've had, and won't be having any more.

"I dunno why everybody's thinking I'm a bad kid" is more of that pity party poor me talk that the judge will have heard repeatedly.

You've done some things. Maybe more, maybe less than "most kids my age" but that doesn't matter. It's all about whether YOU are ready to grown up and change and be responsible and not get into any further trouble.

Yes, going to juvenile would be a depressing experience, and it sounds as though you've got some depression issues going here anyway. Probably some outpatient counseling for issues dealing with this and your relationship with your parents would be much more helpful to you than another trip through the correctional system. Can you request this through the court system? Do you have a CASA advocate or anyone in the system who is working with you? Say you are willing and ask if there is a chance you could have a counselor to work with you instead of going back into the system.

I don't understand why everyone thinks I'm a bad kid isn't something I would tell the judge. I just don't understand why everyones saying I deserve to go back. I don't do drugs, I don't skip class, I don't go smoke weed at the mall, and these are something kids my age and younger do on a regular basis. I know myself that I am not a bad kid, I know that my grades are good and I'm a good kid at home as well. I do try my best to get along with my mom but sometimes she makes it impossible. I'm so scared to go back to juvy because the first time I was there, I felt like I could kill myself, I don't want to have to experience that again. I now know that the littlest things can cause such a big problem and that I need to just stay away from people until I find better friends.

Also, what about a medical reason? Im on birth control because I have really bad periods, seasonique, so I only have 4 periods a year. If I go to juvy I wont be allowed to take my birth control, which means I'll be bleeding the whole time I'm there. And I'm sure bleeding for so long wouldn't be healthy right?
