What is the name of your state (only U.S. law)?

I hit a parked car, I got arrested for DUI and then I passed the breathalizer test. So, they kept my Drivers License because
my brothers name showed up as an alias and he has a suspended D.L. for DUI. Now they know who's who, so how do I get my License back without going thru DMV and having to pay $125 for re-issue and SR22 filing fee.

And you DO know that you can still be charged with DUI even if you do manage to blow under .08, right? CVC 23152(a) does not require you to be over the per se BAC level.

If not, then you should be able to go to the DMV and obtain a new license for whatever the fee is today ... $25? Something like that.

Or, if the agency has not yet returned the license to the DMV and they no longer need it as evidence of any other crime - such as false identification - perhaps they would be willing to release it to you. Typically, however, they are returned to the DMV.
