Driving While Suspended

What is the name of your state (only U.S. law)? PA

Before I get to the main topic of this discussion I have to give you some background information. My license was suspended for 90 days on an underage drinking citation. How ever I do have a Pennsylvania Limited Occupational Licenses which is to get to and from school and work. The first event I will describe is a prelude to the actual event in question.

On 2/1/11 at around 11:00 PM I was sitting outside of a private residence of my friend after driving there on Pennsylvania Limited Occupational Licenses which would not have been valid for what I was using it for. I was sitting in my car with the car shut off and the key in my pocket not the ignition but I was sitting in the driver’s seat. The car pulls behind me with there high beams on and parks there. They then come up to my window and I see it is a police officer of that township, in this case Warrington PA. He asked for my driver’s licenses and proof of insurance. I give them these and he asks what I was doing and I said waiting for my friend to come out. He then asked how I got there if on the Pennsylvania Limited Occupational Licenses I am only supposed to drive to and from school. I said a different friend drove the car. Long story short he said he would cut me a break and not give me a ticket but I had to call someone to pick the car up, which I promptly did.


The following is the actual event in question that I have to go to district court in Jamison PA on 3/29/11 at 1:30 PM.

On 2/10/11 at 2:45 PM I was again driving to my friend’s house in Warrington PA on a Pennsylvania Limited Occupational Licenses. I arrived at my friend’s house at about 2:55 PM and stayed there with my car parked visible outside her house. At 4:19 PM we, me and my friend, got in my car and started to drive away. When we came to the stop sign down the road from her house I saw a Warrington Police Car parked up the street. I proceeded to make a left hand turn toward the exit of the development. The police car followed. I then made a left hand turn out of the development. Then anther non police car got behind me then the same Warrington Police officer that had followed me got behind them. He followed me to a stop light down the street from the development then turned on his Red and Blue emergency lights went around the person behind me and pulled me over. Then he came to my window and asked for driver’s licenses, registration, and proof of insurance. NOTE this was the same cop that stopped me the night before. I then asked him why I was being pulled over. He said because I knew you were driving on a license that’s not valid for what you’re using it for. I then asked him but I didn’t break any traffic laws or any other laws in the time you saw me driving, and he stated no. He then stated that he had gotten a call at 2:50 PM that someone had called in that I was driving over the lines in the road and possible texting and driving, which I was doing nether and using your cell phone and driving is not illegal in this state yet. Then he goes back to his car and sits there writing up documents. Then two other Warrington Police officers arrive put there Red and Blue lights on then walk over to the officer behind be and start talking to him at one point I could see them smiling and laughing. Then one of the other officers that was called came up to my passenger window and asked my friend if she had a licenses and she replied “no” because she does not. At no point did he say anything to me.


Then the officer who pulled me over proceeded to sit there for at least 25 mins sitting in his car not informing me anything that was going on. At this point I knew I would most likely need someone to come get my car so I called anther one of my friends to come get the car. As that other friend is just arriving at the scene a tow truck pulls up. The officers said get out of your vehicle and take anything you will need with you. I then informed the officer that my friend was here and ready to take possession of my vehicle. He then stated I do not care your car is getting towed. After that he made my passenger ride home with anther officer, who in the course of there 4 min ride back to her house made sexually harassing comments aimed at her and me. Then he forces me to leave my vehicle and my friends put me in the back seat of his police car. Then in the course of the ride back the officer makes harassing comments toward me like your going nowhere in life and you’ll never make money like your mom does. Then when we get back to the station he gives me 3 traffic violations and tells me to find a ride home and leaves me in the waiting room of the station. He then gets in his car and leaves then comes back and sits in the parking lot of the station I guess waiting for me to leave. Once my ride shows up he follows us out of the parking lot and down the street until we pull in to a local gas station. Then we were driving up the road from that gas station and he follows us up the street until we pull in a residents then he finally leaves us alone.


I was charged with
1. S 75 S1543 SSA Driving while operation privilege suspended or revoked
2. S 75 S1501 SSA Driving without a license
3. S 75 S3714 SSA Careless Driving

How should I plead to those charges?
Did the Police officer do anything that was illegal?

Should I bring up the following information?
- That he got the call at 2:50PM and waited until 4:20 PM to pull me over even though he stated he knew were I was
- That I was driving my friend to the chiropractor and then I was on my way to school
- That he didn’t inform me of anything while I was waiting in my car
- That even though I had a ride waiting he towed my car regardless
- That he took me back to the station when he could of just gave me the citations and let me leave with my friends
- The fact that the other officer made sexually harassing comments toward my friend and me
- That he made harassing comments toward me on the ride to the station
- The fact that he followed me and my friends after I left the station.


Also I am going to sentencing for a DUI on the 15th of April were I will loose my licenses for a year. Should I mention this to the judge of this case for some possible leanness or in the event that this case results in suspension time maybe delay the start date of that suspension until April 15th?

None of this drama is relevant. The officer did nothing illegal ~ you however, did. If you feel you were harassed, then file a complaint ~ it is your right.

You should lose your license. You have proven on more than one occassion that you don't know how to follow the law.

That's hilarious!

By all means, tell the judge who is trying you for a serious traffic violation linked to drinking that you have been convicted and await sentencing for an even more serious traffic violation involving drinking.

In order to get leniency, no less! :eek:

If you have a lawyer handling the dui, let him also get involved with this.

If you are not represented on the initial court date for the license charges, you may want to inquire what the punishment will be for a guilty plea. You know you will lose your license already, so if the new charges just bring an additional fine you may want to put this behind you. Seems like some probation and fines no matter how you spin it.

He knew where your car was and waited for you to illegally drive again.

- That I was driving my friend to the chiropractor and then I was on my way to school

You would then be admitting in open court to violating your restriction. You might as well plead guilty if this is your plan.

- That he didn’t inform me of anything while I was waiting in my car

He isn't required to.

- That even though I had a ride waiting he towed my car regardless

Why would you deserve that courtesy? The officer is not required to let you release your car into the custody of your friends.

- That he took me back to the station when he could of just gave me the citations and let me leave with my friends

That point is really immaterial.

- The fact that the other officer made sexually harassing comments toward my friend and me
- That he made harassing comments toward me on the ride to the station
- The fact that he followed me and my friends after I left the station.

None of these matter.

Thank you for those who gave me the straight up facts but for the rest of you who are telling me how stupid that was well thank you, like i didnt already no what i did was stupid im trying to see what i can do to get the least amount of punishment. I no what i did was wrong and if i wanted to hear your remarks on how im an idiot i would of said that. So if you have any information that could help me please feel free to share but if you think that making fun of my carelessness is cool or amusing then you need to get off the internet and get a life seriously. Hahaha i mean seriously wow your really cool that your sitting at home making fun of someones else's legal misfortunes how pathetic is that.

What you refer to as carelessness and legal misfortune most of us recognize as a complete disregard for the law. Why do you deserve the least amount of punishment possible?

Based on the OPs last post I believe he may have a very convoluted view of what actually constitutes harassment.

You didn't answer my question. Why do you deserve the least amount of punishment?
