Today i arrived at school and then my friend wanted to have a cigarette across the street in a nieghborhood. We walked across the street and down a cul-de-sac where my friend lit his cigarette. When he was almost done a police officer walked out of the bushes and gave both of us an MIPT. I did not have anything illegal in my possesion but my friend had cigarettes and dip. The ticket says no contraband found. It also says that the stop was 10-19 minutes when it actually was more around an hour. The officer also wrote the wrong time of the incident. Chances of having the charged dropped based on what you said? No

Did you smoke? Did the cop see you smoke? If you didn't and he didn't see you, you can plead your case to the judge. If your friend pleads guilty and can testify for you, then you have a good chance of a dismissal.

Worst case scenario, a fine of up to $250, tobacco awareness program and community service. Of the three, most judges in Texas surveyed favor the tobacco awareness program as their sentence of choice.

The tobacco awareness program may be good for you. (As I sit here with a dip of skoal between my cheek and gum. :D

Once completed you can request that the judgment be expunged from your record.

I did smoke but my cigarette was out before the officer saw me and i exhaled nothing but air. The officer who is infamous for busting kids for no reason in my area climbed a nieghbors fence from where his car was parked to come up on us.

Let's see. First it was your friend who was smoking, then it was you. It's hard to get useful advice when your story changes.

In any event, you admit that you smoked - you're guilty. Better to stop now than to worry about whether you are being unfairly charged.

Did you admit to the cop that you smoked? Guilty

Did you exhale of air with a hint of tobacco on it? Guilty

Could he smell smoke on your clothing? Guilty

The situation you're in is not the cop's fault, he's upholding the law. You on the other hand broke the law.

In the meantime, don't smoke. It's bad for your health and an expensive habit. Money that could go towards a car, college, etc..
