12yr old girl and 17yr old boy

What is the name of your state (only U.S. law)? IL

She will turn 13 in May and he will be 18 in June.

They are dating, but as of right now are not allowed alone together. That is bound to change.

I am sure that sex between them is illegal. But what about other stuff? Where is the line drawn? Kissing? Petting? Oral?

They are in the same school. Does the school have any legal responsibilities to deal with?

And what of the parents? Are they breaking laws if they allow this relationship to go forward?

Are you seriously asking if it's ok to be kissing, petting or performing oral sex with a 12 year old child?

And yes, the school personnel have a legal duty to report any inappropriate behavior between a 12 year old and 17 year old. And yes, if the parents know that the couple is engaging in any form of sexual behavior, they too can be held responsible.

Out of curiosity, just who are you in this situation?

12 year olds date. They're in 6th grade. Dating tends to start in 4th grade these days. Generally just kids saying they are dating and maybe holding hands, but it's a start. By 6th they're beginning to kiss a bit. Then in 7th grade the kissing gets a bit more serious and so on. It's been a long time, but I remember what junior high school was like.

As for the 17 year old, well, that's the problem and the reason for this post.

Why don't you look up IL's age of consent laws (17, btw)? Google is your friend.

By 6th they're beginning to kiss a bit. Then in 7th grade the kissing gets a bit more serious and so on. It's been a long time, but I remember what junior high school was like.
Not all of them. In fact, not all that many of them. I also remember junior high. Most recently with my two teens. And while my youngest had a "boyfriend" at 10, it was really just two best friends hanging out. She didn't date after him until she was 15.

However, all of that is moot. Many parents don't allow dating until the kids are older, and certainly don't allow their prepubescent child to date an adult (which he will be in 2 months). Dunno which parent you're married to, but s/he is an idiot if s/he doesn't see this as a problem.

A 17 year old who is interested in a 12 year old, is either considerably more immature for his age than most boys, or there is SOMETHING sexual going on that the parents are unaware of.

call the police and report the situation. You do not (and should not) report anything as a fact that you do not know. Do not exaggerate but be honest. I suspect if this is obvious to you, it will be obvious to them as well and they will investigate.

and yes, if you are married to one of the parents of the 12 yo, your spouse may be in legal trouble for allowing such an interaction to continue, depending on exactly what has happened and what it can be shown the parent likely knew happened.

I tried google, which is how I ended up here. Too many links, too much legal language that I got lost in. I was hoping someone here wold be somewhat familiar with the law and could point me in the right direction.

I did not mean to imply that all kids date. I just meant that a lot more are doing it at a younger age than when I was a kid.

And it's her mother that is allowing this to happen.

Thanks - this is the kind of thing I was looking for. I will read through it and see where it leads me. If I can't find the parents part I'll let you know.
