A statutory rape case was opened about 5 years ago (I was 16 at that time) with an ex boyfriend and me because I had gotten pregnant. The ex boyfriend and his family told my family that if I was to ask the D.A. to close the case, they would take me into their family and take responsibility. Believing them I did and the case was closed. The D.A. had told me that whenever I wanted to re-open the case, I can always give him a call. I stayed with them for less than a month until I went back to my parents, went through the pregnancy by myself and had my baby there. The father never got involved until child custody and support cases got to him. I allowed him back into my child's life due to not having my father there for me. Now that he is somewhat involved with my child, he is always making rude comments about how he ruined me by becoming a young mom, I ashamed my family, and other rude comments.

So the question is, is it too late to re-open the statutory rape case?

Yes, it's way too late now. The statute of limitations is a maximum of 3 years from the original date of the offense, NOT the date it was reported. By your own admission, it has been 5 years since the case was opened.

I suggest that you find some other way to punish this guy instead of turning to the law to do it for you. Either that, or grow up. Just because he says these things doesn't make them true. Stop listening to it and move on. There's no law that says parents have to be friends with each other.

If he was less than three years older than you were, the statute of limitations ended 4 years ago. If he was 3 years or more your senior, then it ended 2 years ago.

So the question is, is it too late to re-open the statutory rape case?

Unless there was some other allegation, yes.

You can always call that DA's office back and ask, but I guarantee that he/she/they will see it for the vindictive act it seems to be. The fact that they dropped it so long ago indicates to me that he was about your age so it was not worth the prosecution if the child was to be cared for. You should have called the DA back a lot sooner.
