Is there a difference in the way undergraduates and graduate students are treated by the law? What about in private colleges?

With the exception of drinking laws where the vast majority of undergrads are under 21 and the vast majority of grad students are over 21.

The OP also could have meant "the law" to be the police, and the police don't care if you are an undergrad or a grad, or if you go to a private college. "The law" the fuzz, the police, the po po treat everyone equally under the law.

A college or university is free to enact different standards and requirements for each level, and even for specific courses of study to a great extent. What might be required for acceptance into an undergraduate program is not going to be the same for admission into a post-graduate program. The college or university is free to treat the two levels differently in a great many ways.

Legal process must still be adhered to such that students have the same rights to redress, appeal, etc., even if the venues might differ.

Until you provide a clearer articulation of what information you seek, I am afraid there is not a lot anyone can do for you.
