What is the name of your state (only U.S. law)? Wisconsin
History: Owner of rental property next to me would not stop harassing me or stay off my property. She was ticketed and found guilty in municipal court. Filed appeal in county court and withdrew appeal. While at final retrial. The city prosecutor and I were in a meeting room at the court house with the door closed discussing the upcoming trial. We were informed by some one at the court house that she was outside the door listening. She than turned in to the judge an audio recording of us. She has been stalking me for over a year and I did have a harassment restraining order which only made her worse. Is this against the law? Who should I contact? I want her to leave me alone, she has mental health issues and I am will have to testify in two more cases which she is involved in.
 


WS is a 1 party consent state so if 1 party allowed/knew it was being recorded then the recording is not against the law.

Don't know what you meant by "gave it to the judge"...as evidence or what?

George, the only "parties" to that conversation were OP and the prosecutor. Do you suppose either of them gave their consent to be recorded, or were aware at the time their conversation was being recorded?

I am a witness against the person who made the recording. I was talking to the attorney for the city about the trial. I had no knowledge I was being recorded nor did the attorney. No one in the conference room discussing the trial gave consent to be recorded. She was not in the room or party to the conversation. I assumed a reasonable expectation of privacy in a court house conference room with the door closed. She stood outside the door and recorded us through the closed door. The "in use" sign was on the door.

I assume she is claiming misconduct as she has made complaints against several attorneys including this one. She has mental health issues and claims every one is out to get her. So she made a DVD and gave it to the judge to prove misconduct. No misconduct. I took a picture of her in several places in my front yard next to a survey stake on my property. She was found Guilty this was an appeal. She with drew the appeal after recording us. I have been stalked and harassed for over a year. I have made complaints and filed reports.

Why aren't you asking these questions to the city prosecutor you were with at the time? It will ultimately be up to the DA to determine what to do about that.

Sorry do not know why it posted twice. The attorney said it was wrong also but it was at the end of the day. I have not been able to talk to him yet, but intend to when he is back in his office.
